DoD awards Agility $25M contract extension after suspension

The USG is clearly Agility's cash and they appear to be milking it for all its worth.
First of all I find it interesting this award was posted on a Saturday. Was the DoD/DLA hoping no one would notice??
Here is the official FBO (FedBizOps.com) notice of Agility’s 6-month contract extension for Defense Distribution Depot Kuwait, Southwest Asia (DDKS). Although it clearly states the extension is for the sole purpose of transitioning to the new awardee (award scheduled for 31AUG), it still amazes me and others familiar with this situation, that nearly 11 months after their suspension Agility still has this contract. The extension value is estimated at $25M. Jean Howds a regular MsSparky.com reader who’s close to this issue says, “I think it’s suspicious and down right wrong the USG has moved so slowly to extricate themselves from Agility’s grasp!” My opinion and that of others is: the USG was banking on their strong arm tactics forcing Agility to pay a fine and/or settle the indictments. This would have allowed them to keep their contract. Evidently the USG was too optimistic and underestimated the arrogance of Tarek Sultan.

The USG tried to get Tarek Sultan to admit the error of his ways for years. He adamantly maintained that it was a contract dispute. They are dealing with a spoiled, coddled little boy who would rather see the company crumble than to admit his fraudulent practices. The USG was not optimistic, they were downright idiotic to think they would get him to fold. And look, he is being rewarded yet again for his arrogance!!

I’ll LOVE watching Tarek’s Sultan’s largest local competitor, KGL, take the DDKS and Heavy Lift 7 contracts from Agility. Anham is already preparing for the Subsistence Prime Vendor contract handover from Agility, DRMS was lost in June’10, and the intent to sole source the Mail Porter Service to NAS (Agility) has been protested and most likely will be opened to other bidders. EVERYTHING is falling apart for Tarek Sultan and Agility. His arrogance and untouchable and over-entitled Kuwaiti attitude precedes him.

FYI. Agility DGS will be closing its doors for good in the next several weeks. This is a fact straight from senior leadership at Agility. Tarek Sultan himself stated Agility will now be focusing its sights on emerging markets. He’s now clearly challenging the USG to pursue him for years inside courtrooms. Unless you have highly marketable commercial logistics skills, I would highly recommend half a dozen other companies in Kuwait.
I agree. Sultan Center does have the best western expat food selection and they know it. Hence, the inflated prices on our favorite products. Seriously, some prices are three times US prices. Now that’s robbery!

but still Tarek is getting money in his pocket 25 million DDKS extension plus pv extension and the money he is making through kuwait stock exchange. Agility shares are getting high on DDKS and PV extensions. But one thing is clear how long till feb 28, 2011 after that there is no room for Agility and for Tarek Sultan to show his kuwaiti attitue.

Leave it to the USG to miss ANOTHER deadline they set themselves. They have to move quickly to transfer the stock out of Agility, so not sure why the delay. They’ve been planning this thing since last December. Astonishing! Give it another 7-10 days.

My sources say that by December Aglity DGS operations will be sold to a leading US investor and the new entity will be getting all the contrats with superior infrastrure
Any way KGL will be awarded the DDKS project this month , only to be withdrawn later and same will happen to PV .

Investors have tired of Agility’s arrogance and misleading information, not to mention the continued fear of the 6 criminal indictments hanging over their heads. Even with the official announcements of extensions to DDKS and PV, which have been available to the public for over six months, Agility stock has been flat (455 fils). After losing 70% of its value, investors are weary of the company’s future regardless of what the media reports. Investors are finally wising up.

I dont think Agility can fool USG with new name. USG definiatly have a eye on this matter and its not going to be so easy.
Why Agility waited for 7 months to find a simple soloution to keep the contract by establishing new entity. Also why Anham and KGL are investing huge amounts to meets the requirements. Most importantly Agility or its new entity is not run by USG that they will be blessed blindly by USG.

I think the likes of CSA and ITT would be a good starting point based on the countless claims posted on your site. I swear the USG is reluctant to investigate anything OCONUS unless it’s clear and present fraud supported by documentation. The USG relies so heavily on contractors and has downsized so much since the 1980s, they are left with little choice. Even when they do use military and government personnel they are just as crooked. Keven Barnes cites 30+ from the Kuwait contracting office. What a sad state of business.

Kuwait & Gulf Link Says U.S. Body to Review Supply Contract Bid

Sept. 5 (Bloomberg) — Kuwait & Gulf Link Transport Co., a freight company, said the U.S. Defense Logistics Agency will choose the main supplier of a U.S. contract after it receives and reviews KGL’s offer, according to a statement to the Kuwait Stock Exchange today.
KGL received a letter from the U.S. body today which stated that the U.S. government started “correction measures” and that negotiations on the offer initially submitted have been reopened, Kuwait & Gulf Link said in the statement.

Just heard that a US judge dropped the ENTIRE case against Agility due to the DOJ failing to properly serve PWC over the past ten months. Most investors would think this is great news, but an Agility insider just told me the DOJ is deliberating whether or not to start anew. No word on whether the 120+ Agility affiliated companies on the EPLS will be removed. Technically, I guess they have to be. Over the past 10 months Agility DGS has been decimated in terms of contracts lost, personnel fired/departed and reputation destroyed worldwide. It will be interesting to see what the DOJ’s next move will be.

This means the DOJ didn’t follow correct legal protocol. Let’s see if the DOJ will reload and reissue the indictments against Agility and serve the legitimate Agility POC (in hiding?) properly. If the USG passes the service to the Kuwait Government, are they obliged to deliver it to one of its own citizens? Now that’s an interesting question. Maybe Dr. Enezi can answer that one.

Please note that they are plaining to remove the charges against US based subsidery Agility Holdig and it will not effect the charges against Agility Logistics and Agility DGS in Kuwait.

Yep, the DOJ is the best silent partner that KGL could have asked for to keep Agility from competing on DDKS.
I wonder if Agility will file a lawsuit against the USG for keeping them from competing on DDKS – all before being proven guilty in a court of law.
Normally, we cannot even get the Agency (Air Force, Army or DLA) to even add the Contractor onto the Excluded Party Listing System AFTER the Contracting Officer has gone to jail. The DOJ is THEN too busy to get the guilty DoD Contractor who paid the bribes listed, but in the case of Agility – they don’t mind putting them on there prior to proving them guilty AND taking away their contracts. Did something happen to our judicial system that I missed ? Innocent until proven guilty.

I always thought suspending a contractor prior to finding them guilty was an odd and unjust protocol too based on our legal system. Maybe that simply shows how long and protracted the process is and the DOJ wants to protect USG and the taxpayers. LOL. Riiiight. Well, yes they’ve lost and or are losing all of their contracts, but they are still generating millions from Prime Vendor and DDKS. Appears KGL being awarded the DDKS contract is a done deal. The KGL-related stocks (KGL and LOGISTICS) have sure jumped significantly the past few weeks. I assume DDKS, HL7 and the small potential for the Prime Vendor “amended bids” from KGL and Anham have everything to do with it.

None! Ask Keven Barnes (Latvian Connection) if he even submitted a bid for DDKS. Yeah, that’s what I thought! My money’s on KGL based on their land, infrastructure and continued construction. A foreign (non-Kuwaiti) company would have to get a sponsor to provide the land. So sorry, but only Agility and KGL have the required amounts of of indoor and outdoor. Expect the award announcement very soon as the USG must start transferring stock from Agility immediately to meet their own February deadline.

Quick, don’t be so quick to judgment. The USG conducted site visits in June and July and from what I’ve read online and in FOIAs, KGL wasn’t the only bidder with acceptable facilities. Not sure what location Latvian Connection proposed, I think Keven’s keeping this close to his vest, but the USG ruled KGL as the only viable vendor after all factors were evaluated. The USG released/revealed this information, clearly breaking the FAR, but as we all know the USG’s contracting personnel aren’t the most well trained, nor law abiding bunch.

US court gave 14 days to each party Agility and procecutor to submit their proof before the court rule out. DDKS award will be delayed untill Sep 23, 11. DLA will wait the outcome.

Highly doubtful DLA is waiting on the DOJ or Agility to do anything. Both had 10 months to rectify the situation. DLA can’t cross its fingers hoping they will come to a settlement or have Agility removed from suspension, then all forgiven. Won’t happen! DLA must ensure its operations continue without fail or serious delay, therefore DLA will award DDKS regardless of the Agility case.

DDKS award is imminent. Have patience. DLA wants to rid itself of Agility ASAP. Although technically they did receive an extension, the 4-6 month transition was always in DLA’s timeline. Look back at the original solicitation from spring 2009.

HL7 hasn’t been awarded yet, but I’d be very surprised if KGL wasn’t selected. More assets and drivers than anyone in Kuwait, so it will be difficult for the USG not to select them as one of the multiple (up to 4) awardees. That’s if their pricing is in the ballpark. I expect to see IAP, HETCO and possibly one of the current subcontractors selected as well. Agility is still ineligible and sold off over 1500 assets to competitors earlier this year, so they are out of the mix.

The DRMO Contract award to ARU Logistics was just canceled this week after overwhelming evidence that DLA could not ignore regarding the evaluation of how the bids were evaluated.
Camp Arifjan Contracting Officer Mike Diettel conducted a private solicitation of the TAOS (Agility) held contract as a private offering to his own selected bidders list. (TAOS was billing $236,000 per month) This was a 2 year solicitation worth $ 5.7 Million.
This took me 3 GAO protest filings before DLA finally canceled the award. The award drew 4 protesters total.
FEDBIZOPPS is there for a reason contracting officers. Why bypass it or put up your own single sole source when there is competition? The new FAC requires the J & A be posted at the time of the solicitation.
We had USAF TSgt Wakefield who was going to Single Sole source Agility’s National Aviation Services while the company has been on the Excluded Parties Listing System since Nov 2009 AND there were 80 DoD contractors that could perform that contract. DLA’s attorney who originally suspened NAS was astounded at the intention of the Air Force. That solicitation disappeared off of FBO.
The disturbing thing is, this occurred with a PARC on duty and his assistant. LTC Shane Dietrich and Jana Weston. This occurred with General Joe Bass on duty. If he can get the contracting officers to use FBO consistently for the Air Force and Army and DLA, then there would be no need for GAO protests or pushing to have warrants yanked.
Bottom line it seems is that corruption is alive and well in Kuwait and DLA will be conducting this solicitation from Battle Creek, Michigan instead of Kuwait.

There is almost one month over and still there is no news about DDKS award. I guss due to withdrawl of US forces from Iraq, USG is plaining to cancell the DDKS requirement as they might do not need it anymore. Its almost one month from anticipated award date of Aug 31, 10.

Wake up KFC! DDKS supports the entire region, not just Iraq. That includes Kuwait, Afghanistan, Pakistan, ships at sea, the entire gulf, etc. The DDKS requirement will exist longer than we’re alive. I think DSCP is simply taking their time analyzing the costs and getting their ducks in a row. Look at all of the other OIF and OEF contracts. DISASTERS! Is is scandalous that DSCP has taken over 10 months to evaluate, award, and transfer to another contractor when they had the solicitation completed last fall, granted several changes have been made.

The timeline is in the hands of the USG. Appears they are still working out the minute details of the DDKS contract with KGL. Award could be in one week or three weeks. Who knows? Has anyone contacted KGL lately about DDKS or SPV? I haven’t heard anything since KGL’s Chairman said SPV was “still up for grabs” and DDKS was in negotiations.

Note DDKS award is going to Anham LLC this is almost confirmed. I heard from different sources that USG is going to award DDKS to Anham ( A US Co who won the PV.)
My sources says they already receive letter of intent from USG and the award is going to anounce very soon.

KGL is the only bidder. The FOIA posted this on website verifies this claim. Reread the document closely. In addition, an internet government acquisition tracking service confirmed this fact with the USG.

October 7th (today) makes the award 5 weeks overdue, not two months. I believe DLA is trying to squeeze KGL’s price as much as possible. If GAO would have denied the earlier Sole Source Protest by Keven Barnes (Latvian Connection LLC), DLA could have demanded a cost-plus contract. Not sure if KGL has approved cost accounting systems though. Maybe that’s the cause of the delay. Most of the this RFP is FFP, so it appears DLA wants the best of both worlds.
My prediction: DLA will have to extend Agility AGAIN to allow for a proper transition. FYI. Agility is still suspended. DLA disgusts me!

KGL is a well managed co and i am sure while submitting their bid they analyised each component of requirement and they must be aware of requied cost accounting system. They must have required cost accounting system. I am sure their is something else causing the delay like KGL affiliation with Irnians, dispute of killing US Army personnel. Apart from this KGL id s Kuwaiti based co and they are not going to pay a single dollar tax to US Governament from their profit. USG wants a american co to run DDKS so they can pay the tax and recruite more US citizen.

Actually, the DDKS contract doesn’t require a USG-approved cost accounting system. Did you read the solicitation? Unfortunately, only the Kuwaitis (i.e. Agility and KGL) have the infrastructure required to make this happen. Doubtful taxes and hiring Americans have anything to do with it. Both companies employ Americans. A commercial ferry to/from an Iranian port? Don’t think so. I think the USG simply doesn’t want the hassle of leaving Agility, so they’re attempting to force KGL to submit to their wishes. Honestly, I think it’s the USG that’s in a bind, not KGL. Based on this HUGE delay, I foresee a second extension given to a suspended contractor, Agility.
Crazy how ITT is on probation and still wins KBOSSS over several other legitimate bidders. Agility has been suspended for nearly a year and the USG continues to extend their contracts (DDKS, SPV) after ample time has passed to transition to a new contractor. I hope Anham is prepared to takeover SPV sooner rather than later. Speaking of Anham and SPV, whatever happened to the two award protests? Anham still doesn’t meet the contract requirements for force protection standards and pallets. How can the GAO allow DSCP to waive safety standards that may affect our troops? Appears saving money is more important to the USG than contract compliance.
Who knows how long this DDKS award delay will last. I’m not holding my breath.

A month ago USG and kgl resumed negotiations and took corrective measures which is a clear indication that usg in a process to finalize the award, i fully agrred that contract is already awardd and you will see the officail announcement very soooon.

I agree. I expect to see the award announced by October 31, possibly coupled with a supplemental extension to Agility due to the USG taking so long to officially award the contract to KGL. It still astonishes me that the USG hasn’t run full speed away from Agility and Tarek Sultan.

DDKS award announcement is already delayed by two months and this is a massive dealy. I think DLA only wants Agility to perform DDKS and seems they have no intention to announce the award in near future bcz they preffred, like and want Agility. You will see the another extension to Agility soon with no DDKS anouncement.

Officially DLA is going to move DDKS from Kuwait to Bahrain. This is 100% confirmed. KGL is totaly out of businesssssss. DLA is going to extend Agility till Aug 2011 and after that they are going to wind up their Kuwait Operation.

The result for SP3300-10-R-0021 DDKA was announced and awarded to Safe Ports. But the result for SP3300-10-R-0020 DDKS is still pending. who will be the fortunate bidder and when the award is going to be announce.

The estimated six month extension to Agility is for transition and movement of DLA managed material from the current contractor (Agility/PWC) owned facility to a new location to be determined under the competitive solicitation SP330010R0020.
my question is when the result for Sp330010r0020 will be announced? whether its going to be annouced or not? I am not sure. I think DLA is happy with Agility and will keep Agility forever.

KFC is not spreading rumors. KFC posted that DDKA was awarded to Safe Ports, which is correct. KFC also posted that DDKS is still pending, which is also correct. Please look at the post again.

Everybody having some interest in DDKS is so confused about the award. So many rumours around. Somebody says that its already awarded to Agility for another five years. Some says that DDKS extended till Aug 2011 to Agility and then it moves to Bahrain. Peoples knowing KGL they saying that its awarded to KGL and so many others different stories from different peoples. Totally messed up.
But the important thing is that solicitation # SP330010R0020 is not awarded or cancelled. Last modification was issued on May 17, 2010. OOh nobody knows whats going to happened. Does anybody knows???????????????????????

You deal with our enemies – you will not see USG work. Obviously, Pam is putting pressure in Congress that has them taking notice.
Next, KGL just might have some bank accounts frozen and they might be on the sidelines like Agility.
IF – KGL were in the good graces of DLA, and have built the warehouses that they did – don’t you think they would have been awarded already.
Your “reality” and reasoning are flawed.
So “Sorry USG, it doesn’t work that way” is a bit of false bravado. Tell your friends at KGL that IRAN like YEMEN is on our $H!+ List. QUEST should take notice.

My comments of “it doesn’t work that way” refer to the USG wanting everything and not wanting to pay for the superior product/service. I agree about punishing Iran, even if theat means avoiding contractors that conduct any type of business with the government of Iran, directly or indirectly. The USG is taking a hard line to make the sanctions negatively affect Iran, more than ever before. Appears the USG finally has wisened up and is attempting to close most of the loopholes. Has the USG requested such a certification letter from all potential awardees?

John is absolutely right… when a company low balls a contract, the people who really get screwed are the employees who have to do more with less. If a company comes in too low to be reasonable, the government should, without hesitation, throw the bid out… but they don’t. They award the contract, and the employees end up working for peanuts, riding crappy buses to work, just so they can work longer hours (overtime being cheaper than more employees) and live in sub-standard housing.
