DEFENSE: War Contracting Commission Cites Center Article on Trafficking

During a hearing on the oversight of subcontractors in war zones, the Wartime Contracting Commission on Monday cited the Center for Public Integrity/Washington Post investigation into the difficulty of enforcing a U.S. ban on contractors engaging in sex trafficking. It also delved into numerous instances of human trafficking and pressed government witnesses and contractors, especially Houston-based Kellogg, Brown, and Root (), on what they’re doing to stop these abuses.

Subcontractors are companies that work for “prime” contractors, which have a direct contractual relationship with the Pentagon or U.S. government.

“We all saw recently a news article that says the buck is being passed around here” regarding allegations of , said Charles Tiefer, a commission member. “And that is, the IG sends it to somebody else, the criminal people say it’s not ours, and the program manager says it’s not ours.”

“I wonder whether you would favor formalizing the responsibilities, so the program manager has to follow up any allegations,” Tiefer asked three government witnesses. That means a subcontractor or military contracting officer would be “obliged to follow up any allegations of human trafficking and cannot simply say ‘I’ve delegated that to somebody else’.”

All three endorsed Tiefer’s proposition — Edward Harrington, an Army procurement official; Cathy Read, the State Department’s head of acquisition; and Drew Luten, a U.S. Agency for International Development official. Another commission member, Katherine Schinasi, pointedly asked the government witnesses if they knew of any companies barred from competing for contracts because of human trafficking. None did.

During questioning of a KBR official, Commissioner Grant Green asked how the company made sure its subcontractors comply with the U.S. government’s anti-human trafficking clause, which is mandatory in federal contracts.

“We do have a very robust program to monitor the trafficking-in-persons flow down requirement to our subcontractors,” responded Cheryl Ritondale, KBR’s director of procurement. KBR has a team of professionals to inspect labor camps in foreign countries and other means of detection “so we can identify any problems,” she said.

Green wasn’t satisfied with Ritondale’s answer: “You say you have a robust plan. Let me read a couple examples here to you, if I might,” Green said before recounting the following KBR-related incidents:

  • A Nepalese company, Moonlight Consulting, charged a number of Nepalese men a “large fee” and transferred them to Morningstar, a Jordanian job brokerage company, which in turn transferred the men to a KBR subcontractor, Daoud & Partners “for a substantial profit,” Green said. The men “relinquished their passports,” were “held in a dark windowless room,” and were told they would be paid only three-quarters of what they were promised while in Jordan, he said. When they finally went to to work, they travelled in an unprotected convoy on a highway from Amman, Jordan, to Baghdad. Insurgents attacked the convoy, hijacked it, and publicly executed 12 of the Nepalese men.

  • First Kuwaiti General Trading and Contracting Company, a KBR subcontractor, gave Indian men plane tickets that identified their destination as Dubai, United Arab Emirates, but promptly flew them to Iraq instead. Another group of Nepalese men in Jordan were transferred to First Kuwaiti and driven to Iraq. “Their passports were taken and with the burden of a large recruiting fee hanging over their heads, they had little or no choice other than to go,” Green said.
  • After a group of Sri Lankan men brought to Kuwait refused to go on to Iraq, First Kuwaiti General Trading “gave them an ultimatum: agree to travel to Iraq and get more food and water; refuse and get nothing. Be put out in the street in Kuwait City and find your way home. Their [the Sri Lankans’] response: ‘We could not go back, we did not have a ticket, a passport, or money,’” Green said.

“I’ve got more [examples] if you want to hear them,” Green added.

KBR’s Ritondale responded she was not familiar with those specific cases. “But I will tell you that as part of the trafficking persons inspections today, and even into the past, monitoring that the fact those employees are each holding their passport, and that those passports are not being withheld from those employees, is an important element of the inspections that we do.”

“These must have just been exceptions then,” responded Green.

“I believe these may be older instances, but I can check and get that information back to the Commission,” Ritondale said.

Last year, , a former KBR manager, filed an employment harassment lawsuit that also alleged some KBR managers in Iraq were co-owners of a brothel in . Her Texas lawsuit accused the managers of violating the trafficking-in-persons clause of KBR’s contracts with the federal government.

The clause and the company’s own new policy forbid contractor employees from being involved in the operation of brothels, since it is often unclear if the women working in them are there voluntarily or are trafficking victims. The new KBR policy was first revealed in May on a blog called Ms. Sparky run by Debbie Crawford, a former KBR employee who tracks allegations of human trafficking and abetting of prostitution by contractors.

KBR denies Frederiksen’s allegations of workplace harassment and that some KBR employees co-owned a brothel in Thailand.

“When she resigned, Ms. Frederiksen told KBR the reason for her departure was because she wanted to return home and be with family,” Heather Browne, a KBR spokeswoman, said in an e-mail to the Center.

“KBR’s investigation has not substantiated the remaining allegations raised in Ms. Frederiksen’s complaint. The company maintains and enforces policies prohibiting and requires all employees to participate in training on these policies. KBR also maintains and enforces policies prohibiting retaliation as alleged by Ms. Frederiksen,” Brown wrote.

Recently, Crawford’s blog broke news of a July 20 memo from the U.S. military’s Central Command ordering contractors to return employees from nations that prohibit them from working in Iraq – such as Nepal and the Philippines – to their home countries. “In the past three weeks, eight third country nationals (TCNs), several from countries whose current domestic laws prohibit their citizens from working in Iraq, were discovered to have been left behind by their previous employers at various contractor controlled camps (A.K.A. ‘mancamps’) throughout Iraq,” the memo states.     And one more thing. As far as Ms Frederiksen’s reason she stated for leaving KBR….“When she resigned, Ms. Frederiksen told KBR the reason for her departure was because she wanted to return home and be with family,” Most people don’t give the true reason to HR when they leave. I didn’t. That just gives KBR more reason to deem you a disgruntled employee, list you as “Not Eligible For Rehire”, fire you before you can get DEMOB and if they think you are really angry and a security risk they very well could confine you to your room with a security guard. You walk out of there on eggshells. You can’t really breathe a sigh of relief until you are at Dubai International Airport. If HR and KBR management gave no support while employed, what makes anyone think they would give it on demobilization. Plus there is no guarantee that is actually what Frederiksen put on her DMOB paperwork. KBR HR is known for changing it. I put “No comments at this time” hard telling what mine actually says.

      You always put no comment, hell if you really write what you feel then of course you will be black balled by any company. Come on sparky spread the wealth so KBR was the only that got roasted about human trafficking and they said nothing about Fluor or those other companies? I see some fuzzy math here. Fair and balanced reporting yeah right.

    There are plenty of other corporations (some from the USA) that engaged in similar activities. But not the extent of trickery and holding passports. Even the gov was involved putting people on mil-air flights that crossed borders but that stopped eventually.

    Although the true definition would be Human Smuggling, because the employees (from asia and africa) are willing and active participants in the transportation. Some major airlines charged special fees to transport them to a transit airport (kuwait, istanbul, dubai) if they could prove they had a ticket on an onward flight into the country. There are also airlines and companies that specialize in getting paying people in and out of theater.

    Does Trafficking in persons include confiscating- holding employees passport and making them sign for them whenever they need them and if so why do Government Agency’s still award contracts to companies and Sub-Contractors that knowingly do this.

        No Kuwait Official is well organized. Their 4 wives keep them in tow. Their maids wash their cars and keep their laundry clean because Kuwait women are too lazy. Maids look after their children and the cycle of laziness goes on. Their Indian and Lebanese staff do all the work.

        We are putting pressure on them to end their other occupation – Human Trafficking and the law makers, MPs, Judges, and all who pretend to be concerned are all traffickers to one degree or another.

        Even the Ambassador of Niger wants his maid to pay him 300 KD in order for her to go and get another job. There are over 100,000 Kuwaitis out of the 500,000 men engaged in selling visa on some scale or another. This Kuwait Wasta is nothing other than organized crime. The rule of law in Kuwait is based on palm reading, horoscopes, and reading tea leaves.

        The State Department and the Army have sold out America’s integrity when they do not have Federal Minimum wage in the USG contracts.

        The State Department in the Green Zone had 12 Global securitymen to a normal trailer – and would not approve an increase. THAT is discrimination. The State Department kept them at risk by denying them enough Hard Cars to transport themselves from BIAP to the Green Zone. THAT is discrimination and DCMA was behind that all the way.

        WASTA is only a concept that is coming to the end of its life cycle just as slavery in Kuwait is too. Sorry Kuwaitis, you will actually have to GET ORGANIZED – your maids cannot do everything for you. But we are happy to keep you on the trafficking list.

        The State Department hardly has room to talk and neither does the Army when they are hiring anyone other than Americans for any job that provides labor in these tough economic times in America. Wake up Hillary.

    I agree with Pam for the most part as she hits the nail on the head. I do disagree with this part. Not all of it is forced labor. Intimidation does run rampant. It is actually the fear of no jobs at home that keeps people here and in fear and the employers know this very well. The sad part is that if we as Americans had been as frugal as some other people and not lived by credit we would not be here and abused. Again, much of the blame needs to be shared. For me, my bills have been paid off by at least a year or more and I am building up my savings. I took a step back and noticed what I did wrong. No more trips to exotic places, new cars, etc for me.So my blood pressure remains low now.

    Those clauses they discuss are meaningless. Here is why. The U.S. Army and State Department both condone human trafficking in all its forms. DCMA and DCAA do not audit for it and the U.S. Army are too corrupt to ever suspend for it because they are documented on a scale not seen since WWII for taking kickbacks and bribes and NOT overseeing their contracts. In Kuwait they leave the trafficking violations to KRH, their cleaning company and QUEST. They receive kickbacks to look the other way. They have cleaners on the base under CSA making 17 cents per hour and other personnel making 200 dollars per month and that is ok with the US Army and DCMA. Americans need jobs and they should get first crack at it. At least they are American and can get clearances.

    The U.S. Army cannot, even with a 3 year old Army Contracting Command oversee a contract for ANY of its terms and conditions. They cannot even conduct clean contracting. They are now in the process of wire fraud by hiding solicitations, and therefore the terms and conditions, the awardees who may, if anyone can monitor the award, human rights violations, bid-rigging (Army Specialty code now) let alone the other 50 plus clauses. They are hiding the solicitations under http://www.usmilitarycontracting.com which is tantamount to wire fraud. The site was purchased under a SFC Chadd Cobb using his gmail account. What does the ACC and General Joe Bass have to say about this.

    Joe Bass is going to get called on this and it will cost Joe Bass his star. I will make a steak dinner bet on that.

    Indonesian minister heads to Saudi

    JAKARTA – Indonesia demanded an investigation Friday into reports that a domestic worker was allegedly killed by her employer in Saudi Arabia and thrown into dumpster — the second case of maid abuse to emerge this week.

    President Susilo Bambang Yudhoyono was speaking to reporters after a Cabinet meeting called to discuss the need to protect hundreds of thousands of migrants who flock to the Middle East in search of work.

    Too many, human rights groups say, face slavery-like conditions, torture, sexual abuse and even death.

    Indonesian Minister of Labor Muhaimin Iskandar said an embassy team was dispatched to the Saudi town of Abha to look into allegations the 36-year-old maid, Kikim Komalasari, had been killed by her bosses.

    Her neck was slashed and she had severe cuts to the rest of her body, he said.

    The US needs to cancel the deal to Saudi of the fighters and Kuwait needs no further help until maids are all sent back to their countries of origin. If the U.N had balls, they would declare that those countries that normally supply maids are no longer allowed to until trafficking, withholding passports and detention has ended and every ex-pat who enters the country is free. No, the U.S. is 2-faced and will continue to ignore Saudi, Kuwait, Bahrain, Qatar, Jordan, UAE, because we need their land to launch from. No, it is them that need US to not have the Iranians take over their countries. When will the US really get some ethics to go along with that BS Human Rights BS we babble.

    The Wall Street Journal reporter Joel Millman was just in Kuwait to do a story on the maids. When will we see it Joel. It is not a story that can get written enough about – not until the Visa slavery system is abolished in every GCC country. But like reporter David Phinney – it probably won’t get written about because it isn’t sensational enough and these abused women don’t need a spokesman like you. They are locked in their Kuwaiti jails called homes and apartments with no freedoms while you are free to write or not write.

    At least one Saudi prince who violated the Quran and being a homosexual and killing his maid in England did get justice. Is locking up maids part of the Quran. Is driving nails into their hands part of the Quran. Any muslims out there want to comment on this ? We Christians stopped that practice when the Romans disappeared off the face of the earth. Why are the muslims doing this. Any defenders of them.
    Why are Muslim women so lazy that they need maids ?

    It is time that American ethics, policies, and our standards are in our USG contracts and we set the rules. They don’t like it – too bad.

    Kuwait’s Arab Times have heard from me a few times when they start defending this abuse. They cannot even ever name the abusers. Kuwait does like to hide their criminals. They did it when 15 Kuwaitis were going to raid Camp Arifjan and they do it when the Kuwait women abuse and kill the expat maids.

    I just dare one of these Kuwait women to try to put some nails in an American’s hands. That just might be their last day on earth. The sooner these lazy Kuwaitis lose their maids – the sooner Kuwait will be on its way to getting off our Sh!+ – List.

    I am standing by waiting for any defense for the Saudi’s killing their maids and putting nails in their hands or cutting their lips with sizzors. Or to defend the Kuwaiti’s staging murders of their maids, putting nails in them, setting them on fire, locking them up, or the other 3 or 5 stories I see in the Arab Times every day.

    Maybe one of these Muslims can explain why they lock their maids in apartments so that they have to rappel down to escape their kidnappers.

    I am waiting………

      I don’t see that one Muslim has stepped forward to defend this coward Kuwait man and his wife who held this woman down and drove nails into her hands on multiple occasions.

      They don’t condemn it either. But they collectively sure as hell shut their mouths.

      We need the United Nations not to shut their mouths on this and to file an international Human Rights Abuse case against the Government of Kuwait for not immediately ending their system of slavery called Visa 20.

      Who from the Kuwait ruling family wants to be on the other end of a Human Rights Violation case. Name them and let’s get these charges filed on behalf of the maids of Kuwait. It is time that the 5th Century Kuwaitis learned about some 21st century justice.

    Here are 2 examples of Muslims torturing their slaves in the 21st Century after the Death of Christ.
    In the Roman Era, nails were used on men between the 6th Century BC through the 3rd Century AD.

    It is time for the United Nations to demand that no more slaves be allowed to go to any GCC countries until slavery is abolished. Kuwait Airways is a modern-day slave-ship of Kuwait and the slavers troll India, Philippines, Nepal, and Indonesia looking for their victims.

    Who wants to defend these Muslims and these lazy GCC women and men who abuse these women and who keep imprisoned in apartments and houses – then torture them and are killing them at an aggregate of over 50 per week between all the GCC countries. Suicide is a murder. Passport withheld. Denied going home. Overworked. Sexually assaulted.

    If this doesn’t embarrass you and your religion then no doubt your suicide bombers coming from your religion don’t either.

    We – Christians – have had enough. I would say these maids have had enough of the GCC country’s abuse too. You don’t lock up your maids and you don’t torture them. We chose who we do business with and don’t think for a second we owe one Arab one thing just because we want keep Iran in check.

    If you are an offended Muslim – too bad. Get on your countrymen and women.

    just as I thought – not one person, man or woman can defend the abuse of maids in the Kuwait, Saudi Arabia, Jordan, Qatar, Bahrain, or the UAE, yet it was a husband and wife that held her down while the hammered nails into her hand. Those 2 are Lazy cowards.
