Did KBR knowingly allow a rapist to go free in Iraq?

I first blogged about the brutal rape and assault of former KBR employee Anna Mayo on December 4, 2009 and then again on June 4, 2010. Anna was raped and brutally beaten in broad daylight in her living quarters at US military installation Joint Base Balad (JBB) in Iraq on November 30, 2009 at approx 11am. It was clear, this psycho would not be satisfied with brutally raping Anna as he tried to beat her to death as well. Anna’s injuries were so severe she was medivac’d from Iraq to Germany for extensive medical treatment. Word spread fast of this brutal attack and I was contacted by several concerned JBB residents.

Naturally, there were countless rumors as to who this rapist was. I received information the rapist was a Defense Contract Management Agency employee (DCMA) employee, a boyfriend and a soldier to name a few. According to my sources, it has been confirmed the rapist is a KBR direct hire Third Country National(TCN) from India. Apparently this rapist originally worked for Prime Projects International(PPI) and was then hired to work for KBR directly. Although I heard he was a truck driver,  as of yet I am still unable to positively confirm his job title. Anna’s attorney Todd Kelly states “This KBR employee and rapist left Iraq and returned to India eight days after the rape”.

As if the brutality of this attack were not bad enough, there was allegedly some dubious investigation techniques employed by KBR security officers after the report of the rape. This  involves among other things work gloves and a trash can. I’ve been told on several occasions that KBR security officers allegedly planted gloves tainted with DNA obtained from Anna’s room in an outside trash can. This is how these incriminating gloves were miraculously found by KBR security in a random trash can in a random location within hours of the rape.

There are several theories as to why two seasoned security professionals would allegedly tamper with the evidence of a crime scene:

Theory # 1:  Because this rapist was a direct hire KBR employee, these security officers either under direction from higher ups or on their own were trying to divert the Army Criminal Investigation Command (CID) investigation away from the actual rapist in an effort to save KBR from anymore bad “rape” publicity.

Theory #2: It is possible these security professionals had a “hero cop” complex and they wanted to be the ones to “crack” the case.

Theory #3: They are just freakin’ idiots!

Theory #4: A combination of all the above, although there should have been enough evidence in the room and with the rape kit to crack this case wide open if KBR had fully cooperated with the CID investigation.

Although this was obviously intended to be top secret operation, this alleged evidence tampering is allegedly common knowledge amongst most KBR security, human resources employees and senior management at JBB and HQ in Baghdad. Apparently, employees are fairly well disgusted with the whole thing and want nothing to do with it. Even though they have allegedly been threatened to NOT talk to anyone including CID investigators, they want to talk.

Here’s what I need from you, Ms Sparky’s most awesome readers. I need more names. So as not to limit your brainstorming abilities, I’m not going to publish any of the names I already have. You tell me the names we need. The names of the mangers who quit, resigned, transferred or covered up this alleged incident. The names of the security officers, the name of the rapist, names of witnesses. I would prefer if you did not publish the names as a comment. Send it to me by clicking on the Contact Us tab above. All information I receive will also be sent to Anna’s attorney, the CID, the DoJ, the DODIG and any other damn acronym I can come up with who will investigate this crime allegedly committed by KBR security and managers.

KBR has a history of protecting and promoting their accused rapists and deviants such as the allegations made against James Seaton, HERE and HERE, William Risner and Charles Boartz to name just a few.

“KBR continues to deny any responsibility for these actions. The courage of Anna Mayo and others, including Jamie Leigh Jones, have been instrumental in this battle for corporate accountability. It is our hope that others with direct knowledge of contractor sexual abuses and cover-up will come forward to help stop this giant company from forcing young women to endure these types of torment” says Kelly in an email statement to MsSparky.com.

KBR has let this rapist get away and he is now walking the streets. From the brutality of this rape chances are he has raped before Anna and he has probably raped since.

Ask yourself this. Are you willing to lie to protect these losers. I’m not sure what level crime tampering with evidence is with regard to the Army CID, but in the States it’s a felony. Please  come forward.

    Army CID???? Some are terrific and dedicated,
    but when some classify such rapes as Lavenia
    Johnson as suicide, for that matter, Pat Tillman’s
    case–I would not rule out CID as a possibly
    complicit in any cover-up.
    In Bosnia, we were briefed by CID that we could always come to them, totally circumventing any disclosure to our contracting company.
    When two of us did, the company found out through higher level meeting/report, and then the site manager mandated that we inform our supervisor first, and must have management present if they permit us to report a security violaton/crime to CID–or face immediate termination.

      It never occurred to me the Army CID could be complicit in protecting KBR. I’m not sure why after the Ryan Maseth electrocution investigation. The investigators in the field may make their finding, but when it all gets to DC and by the the CID makes a statement to the press or to attorney’s it’s a whole different animal!

    Someone needs to put in a FREEDOM OF INFORMATION ACT REQUEST request to get a copy of the KBR’S LOGCAP contract. It sounds as if KBR has facilitated with obstructing the investigation of a crime and those managers and KBR should be held accountable for violating the Terms and Conditions of the Contract.

    (I bet the Army didn’t know this was applicable to TCN rapists did they – of course the American citizens need this with the level of protection afforded American Expats due to the investigative abilities of the Army CID and the USAF who were charged with base security) Or Army, are the women being left at the hands of Triple Canopy or a CSA or ITT Guard Force. Secretary of Defense Gates – you have failed once again buddy.

    Where is the Air Force on this cover-up. Where is the DOJ on this cover-up. Where is the Army on this cover-up. Did KBR managers do a similiar act in the Green Zone in 2006

    So, if the below notification went to all employees of the subcontract by flow-down clauses and that it was KBRs responsibility. Then why is KBR aiding and abetting criminals in fleeing justice. And where once again is the FBI, U.S. Army CID, and the Air Force OSI.

    It is hard to investigate when you are spending your time covering up.

    Find out who those KBR managers were and fry them. Find out who was in charge of the investigation and get a copy of the report.

    Are you telling me this rapist didn’t have a CAC card, eye scan, fingerprints, and a complete bio. No, it is there, but if the FBI and DOJ cannot figure it out, then it would seem that once again [emphasis] there is a cover-up at Governmental level. Certainly there cannot be 4 agencies all that are incompetent – so that leaves a cover-up Ms Sparky.

    6. MILITARY EXTRATERRITORIAL JURISDICTION ACT (MEJA) (18 USC 3261-3267)
    Per the MEJA Act, following notification of contract award, the Contractor, and all subcontractors at any tier, shall provide the following notification information to all employees and ensure it is understood by each employee. The Contractor shall report compliance of this clause to the Contracting Officer following contract award and upon request. The Contractor shall respond to all requests for reports regarding compliance of this clause in the manner and with such content as is specified by the Contracting Officer and at no further cost to the government.

    The Contractor, and all subcontractors at any tier, will be responsible for informing each employee of the below notification by sufficient means of actions to ensure all employees have received and understood the notification. Such actions may include, but are not limited to, providing each employee a copy of the notification and obtaining a written acknowledgment of their understanding, posting the notification in a conspicuous place frequented by its employees as well including the below notice in employee manuals or employment information. Employees who are not literate (who cannot read) shall have this notification read to them in a language understood by such employee. The below notification will be provided to all employees no later than ten days after being hired for this contract or arrival in the foreign country in which they will be assigned, employed by, accompanying the US Armed Forces, or residing as a dependent. The contractor shall maintain a copy of each employees written acknowledgement of receipt and understanding of the notification and shall provide the same upon request by the Contracting Officer. The Contractor shall comply with all notification requirements of DoD Instruction 5525.11, Criminal Jurisdiction over Civilians Employed By or Accompanying the Armed Forces outside the United States, Certain Service Members, and Former Service Members. In the event of conflict between DoDI 5525.11 or any applicable U.S. military regulations, DoDI 5525.11 and/or applicable U.S. military regulations or orders will control over this clause.

    The notification referenced above is as follows:
    Notification: Under the Military Extraterritorial Jurisdiction Act (MEJA) (18 USC 3261-3267), persons employed by or accompanying the U.S. Armed Forces outside the United States are potentially subject to prosecution for certain criminal acts, including such acts occurring outside the United States. MEJA applies only to those crimes punishable by imprisonment for more than one year if committed within United States jurisdiction. The law applies to individuals accompanying a contractor for the US armed forces, which may include a dependent of a DOD contractor or subcontractor employee. This law authorizes DOD law enforcement personnel to arrest suspected offenders in accordance with applicable international agreements and specifies procedures for the removal of accused individuals to the U.S. It also authorizes pretrial detention and the appointment of counsel for accused individuals. See Army Field Manual 3-100.21, Contractors on the Battlefield and DoD Instruction 5525.11, Criminal Jurisdiction Over Civilians Employed By or Accompanying the Armed Forces Outside the United States, Certain Service Members, and Former Service Members.

    I see the word Army Field Manual which I guess implies Army. This woman is at the whim of another Army cover-up. The U.S. Army Contracting Officers cannot oversee a simple contract and this is just fluff to make Congress think the Army has changed it’s ways when it obviously has not – or they would have this guy in custody and Ms Sparky would have his picture.

    Senator Clair McCaskill – are you reading this. Another example of why the U.S. Army is fired out of contracting and this is turned over to DCMA.

    The DOJ can do nothing and will do nothing.

    That leaves you women to take the law into your own hands. Give the DOJ bodies and your statement, maybe then they can do their jobs.

    “I said, ‘Dad, I’ve been raped. I don’t know what to do. I’m in this container, and I’m not able to leave,'” she said. Her father called their congressman, Rep. Ted Poe, R-Texas.

    “We contacted the State Department first,” Poe told ABCNews.com, “and told them of the urgency of rescuing an American citizen” — from her American employer.

    Poe says his office contacted the State Department, which quickly dispatched agents from the U.S. Embassy in Baghdad to Jones’ camp, where they rescued her from the container.

    What has the inaction of the cover-up or ineptitude of the U.S. Army and the DOJ caused?

    I didn’t actually see anyone plant the gloves. But I know for a fact that (name edited out) and (name edited out) was the KBR security who investigated this unthinkable crime and found the gloves. Those two are in it thick as thieves. Then you just keep going up all the way to the top. (name edited out) is an idiot but is buddies from (state edited out) with (name edited out)and will cover his butt at all cost. Several people involved in this have been transferred out. (name edited out) is about as corrupt as they come and he has been transferred to Kuwait.     You know what I just found out…when you out process for R&R they have you check in your computer with IT for what they call a “DOJ” back-up. In reality, they have been going through your e-mails from the hard drive. For desk-tops, they send an IT tech over for “preventive maintenance:’ This is here at JBB, anyways. They have been doing this for a year or so but since this case with Anna, they have been actually going through your e-mails to see, if possible, who’s been e-mailing Ms. Sparky, the Houston Press or ayone else. Ron Allen is one of the worse of the worse. He’s got everything related to Anna’s case but becuase he’s a lawyer, he can claim client privilige. He’s a quack and Nifong his/was his lackey. (name edited out) should be indicted as well. He’s been known to “sleep” with the help and has connections to people covering up the incident.

    This whole planting the gloves then miraculously finding them is a joke. Virtually every person who works with their hands in Iraq has work gloves. And if they get them from the same KBR tool room they all look the same. They get thrown away all the time. What made these random pair of gloves in a random trash can stand out. Maybe the security guy took the time to write the rapists name on them before he allegedly (my attorney makes me say that) planted them as well. I just can’t believe Cusick is not lopping heads off. Must be same shit different General. I could be way off but I believe there is a good chance this case had something to do with Larry Lust, Guy LaBoa’s and Rich Kaye’s sudden departure from KBR last Spring. And if it didn’t is should have.

        Yep,ITT had us living 3 to a room in the Balkans,with each occupant on a different shift,which meant some one was constantly up and about, making noise and burning lights in the room.There were several empty, perfectly good buildings allocated to ITT that remained vacant the entire time there. My point? ITT pocketed several million in saving end of contract bonuses due to people up and leaving in disgust at this and myriad other petty(and some not acts of harassment. 26 out of 120 finished the year.

        We had a sexual assault there too,with our moronic ‘black hat supervisors’ duly covering up and bullying and intimidating any and all that dared even speak of it.

        The deputy project manager was former Army CID and the whole thing was squashed with the Army-until enough people grew a pair and spoke up…then their buddies were simply sent home.The victim and witnesses were all long gone by that time,shipped off or harassed into quitting…

    I would like to thank everyone who had the courage to come forward, even under threat of termination to report names and other information.

    It has been very very quiet on this matter since I sent my reports to the DoDIG, CID, DOJ, CWC, several Congressional investigative committees, individual Senators and Representative who I thought would push through on an investigation.

    I notice my traffic has increased exponentially in the last day or so from the State of Louisiana. Hmmmm

    Maybe the investigation has started!

    Someone from Iraq just sent me an anonymous email stating the Army CID has reopened (the once closed) criminal investigation into the alleged evidence tampering by KBR Security Officers in the Anna Mayo rape case.

    Due to the fact I am not on the email distribution list for all the Army CID updates there is not way to confirm that.

    What I can say it I sent my report to everyone I could think of including Army CID Commander Brigadier General Colleen L. McGuire.

    I can only hope the Army CID has reopened this investigation. If the CID finds there was in fact evidence tampering, I hope they take it all the way to the top including Ron Allen and Kenly Nifong. I hope the DoJ actually files charges.

    And most importantly, I hope this rapist that KBR let get away is found and extradited back to the US to stand trial for his crimes.

    I do not work for free. I work for justice. I chose a profession that allows me to do what I believe. I do get paid for my work. Most of the people that I represent could not afford an attorney at all if they had to pay one by the hour. Therefore, I work on a contingency fee: I take ALL of the risk, I pay my staff, I pay for experts, I pay for filing fees, I pay for court reporters, I pay for transcripts, I pay for necessary travel, I pay ALL expenses, I put in countless hours of work (often 20 hours per day) – neglecting my family, my friends, any social life, and many other potential sources of income so that I can try this case – because I believe in it. IF I am successful, THEN (and ONLY then) am I also paid. Otherwise, I have worked for FREE – in this case for five years – so that one woman could stand up to a mega corporation. Is there ANY other profession in the world that “puts their money where their mouth is” like a trial lawyer? No! The “frivolous” lawsuit is a myth propounded by those who have had to pay for their misdeeds in the past – so that the average American cannot gain access through the courtroom doors. You can criticize and ridicule us all you want, but your doctors, plumbers, accountants, IT technicians – any other profession – gets paid for their work. We often don’t. When we do, we are rewarded for the risks we take. Until you have walked in my shoes – or the shoes of an injured victim of abuse or neglect – be careful about your unfounded opinions. Do you work for free – or just criticize those who do?

      Mr. Kelly, I applaud you for your efforts and tribulations however, I would hate to see you get run out of business on the Mayo case. Have you really checked the facts and background on the victim? Have you really checked her AF tenure, records, disorders and prior to that drug issues? It’s common knowledge of Jamie Leigh’s background and wheter that hurt her case is debatable but I hope your looking real close at the Mayo case and background…I believe KBR will have some suprises in store but good luck.

      I’m a tested combat veteran. I do many things within my community. I help feed the homeless every saturday, and I am a heavy donator to Habitat for humanity. I know all about giving and never expecting nothing in return. I have EARNED my right to say whatever I please.
      You can manipulate the truth all that you want. that’s what attorneys do. But do not insult my intelligence by telling me that you do all that you do for free. I’m sure that your eye is on the prize at the end of the day.
      How many of these ‘contingency fees’ have been from non-mega companies where the little guy wants a small amount of justice.
      Again why would you choose mega-companies to sue? ???????/ You have only painted a clearer picture

You talk about eleven years in service, was all that time behind a desk? The only thing better than a half a plane load of Lawyers crash landing is if the the other half of the plane is Psychiatrists. You are in it for the money, period. I you win 20% of your cases you are doing well. When it gets pass the BS and gun smoke it is about money for you. Do not propose it is anything else.

    how dare you compare yourself to a Doctor, plumber, or even a soldier.
    You leave the Marines and become an attorney to help the downtrodden? There just wasnt enough attorneys around that work on a contingency basis where there?

    Those are people that help the downtrodden. My google search found these all around the country…..Where’s yours Todd? Not enough profit in these types of cases.

      “volunteer” otherwise known as pro bono attorney’s have clients that are not pro bono. They have expenses just like everyone else. And let’s not forget the enormous amount of money Todd Kelly spent representing Jamie Jones on a contingency basis. You really know nothing about these cases do you?

    Its wierd I helped a bit on investigating this one, I never knew it was Anna who got raped, as I knew her. I only knew she was a few years older than me, was white, had darker hair, and I was described the injuries. Within Hours we were told that It was probably a PPI, IPBD, or Kulak employee, we were told that the suspect was indian, we were also told that the spare key was stolen from billeting. I believe that ITT had taken over billitening by this point.

    I along with every member of safety, security and management, searched the base. Looking at every one who resembled an indian’s neck, I felt we trampled on the rights of every indian on base looking at their neck and face. But then the word was she clawed the crap out of him and she had plenty of DNA under her nails, where the DNA went I don’t know. They should have had CID do a thurough investigation.

      Oh and I forgot she had reported this guy before and asked to be assigned a new room I believe. I believe it was also denied citing some LOGCAP Army policy. The same thing they said when my AC went out and When I got a whole in my roof and it flooded.

      We were not allowed to relocate rooms, unless we transfered to a different section, I.E. TTM to JMMT, or CLSS to TTM.
