You’re Suspended ! You’re Debarred! Here’s another contract!

There is a lot of talk these days about suspending, debarring and the government “reigning in contractors.”  It appears to be a toothless threat and the ones left holding the bag are ultimately the US taxpayer and the unfortunate troops being serviced by these rogues.  I have said it before and I will say it again the DoD & the DoS will spank their unruly contractor, in public, then turn around and award them millions, sometimes billions, in new contracts

A perfect example of this is toxic and costly relationship was the Pentagon making  a very public display of withholding $25 million in award fees, from KBR on February 25, 2010, then on February 26, 2010 notifying KBR that they had been awarded the $2.3 billion dollar CTP contract from guess who; that’s right, the Pentagon.  I have to wonder what KBR is holding over their head, do they have compromising photographs or is it just plain old fashioned threats and intimidation.  I would hope that the Secretary of Defense, who is charged with keeping America safe, is not being held hostage by greed driven corporate bullies. 

Given the Pentagon’s spineless effort of enforcing ethics and accountability amongst their contractors, I have to ask what does suspension or debarments mean to the Pentagon and their contractors.  I did a little research and apparently suspension and debarment doesn’t have much  of an impact or many repercussions.  The Project on Government Oversight (POGO) did an investigation in 2009 and found 25 cases of companies and individuals receiving government contracts after suspension or debarment. 

If you look at recent news there have been several FCPA indictments, convictions and of course plea deals.  has been awarded new contracts left and right and Agility is working for the UN, in Haiti.  Agility is suspended from bidding on new work but that doesn’t mean the work stops on existing contracts and what about contract extensions?  The DoS is extending their Embassy contract with the contractor that caused international embarrassment to America with their naked, alcohol induced, escapades.  While I am at it they have been extending LOGCAP III since 2006 and it may be extended, in Iraq, until the end of troop engagement there.     I think it is safe to assume that Agility with 6 indictments will probably continue their business as usual with the US government. 

Here are comments from one of Ms Sparky’s readers, regarding Agility and the DDKS contract:

DDKS solicitation was released this weekend and the projected time line indicates that Agility, a suspended contractor with 6 criminal indictments, will be extended for 6 months to allow the new awardees’ to transition operations to their facilities.

Agility was suspended over 4 months ago!  What took DLA 4.5 months to release an RFP after they had a new solicitation completely written last spring?  This is incompetence at its worst!  Shame on the USG, for wasting taxpayer money and allowing Agility to make 6 more months of profit.  Gross revenues for an additional 6 months will cost taxpayers approximately $19M!  Disgraceful!

Of course there is always an excuse or exception aka  a weasle clause and of course the DFARS has one too:  

SUBPART 209.4–DEBARMENT, SUSPENSION, AND INELIGIBILITY

209.405  Effect of listing.

(a)  Under 10 U.S.C. 2393(b), when a department or agency determines that a compelling reason exists for it to conduct business with a contractor that is debarred or suspended from procurement programs, it must provide written notice of  the determination to the General Services Administration, Office of Acquisition Policy.  Examples of compelling  reasons are—

  1. Only a debarred or suspended contractor can provide the supplies or services;
  2. Urgency requires contracting with a debarred or suspended contractor;
  3. The contractor and a department or agency have an agreement covering the same events that resulted in the debarment or suspension and the agreement includes the department or agency decision not to or suspend the contractor; or
  4. The national defense requires continued business dealings with the debarred or suspended contractor.

In a Senate Armed Services Committee Hearing Sen. Claire McCaskill made harsh comments about the state of the procurement system:

Indeed, in some instances outside agencies charged the Pentagon a fee and then used the Pentagon’s own contractor list to buy goods and services for the military, said Sen. Claire McCaskill, D-Mo.

A state auditor before she was elected to the Senate last fall, McCaskill said, “I don’t know whether to laugh or cry” over the IG report.

Quizzing Gimble about the Army office buildings built at Fort Belvoir, she asked, “Doesn’t somebody get fired?” When told probably not, she said, “If there isn’t accountability with something like that, we may as well throw in the towel.”

Hopefully things are changing but in the meantime the American taxpayer and our troops are stuck with the status quo.  If the Pentagon would pay  as much attention to their bottom line, as these dubious defense contractors do, perhaps we would get a lot less lip service and some real accountability.

    Exactly! I read through the RFP released last week and thought the same thing. Why would DLA/DDC allow Agility to hold onto this contract any longer than it absolutely has to? Answer: DLA/DDC had no contingency plan and/or would prefer to stay where they are for as long as they can. A “Don’t rock the ship” mentality. Unfortunately, Agility is barred, potentially permanently, from USG contracts and now DLA is forced to move out. Essentially the USG is evicting the USG. The USG makes exceptions for itself when it’s convenient. Best interest of the US taxpayers? My ass! Why must the US taxpayer pay millions to a corrupt contractor named Agility while DLA straightens their sh*t out?

    That little “oldie, but goodie” reminds me a lot of the majority of the postings I see in this forum. ALL defense contractors are bamboozlers, bloodsuckers, charlatans … and all Govt procurement/contracting personnel are incompetent boobs. Of course, the posters all the tremendous insight, intellect, and foresight that most mere mortals can only dream of.

    I am by no stretch of the imagination of friend of Agility, KBR, Halliburton, or any other large defense contractor … but not for the reasons most often listed in this forum. I’ve worked with these companies for years in a consulting role, and am well aware of the good and bad of each. Well, guess what? They’re not any more honest, nor more crooked than just about any other company I’ve run across in my 40 years of doing this kind of work. They have personnel who are upstanding, outstanding, and honest as the day is long … and then they have some that are not. But, I will say the former far outnumber the latter – unfortunately, it’s the latter who get all the press.

    The Government’s in quite the conundrum … so many of their senior procurement folks have left (and now work for many of these defense contractor), leaving behind the young (however sharp they be, they’re still inexperienced), and those who can’t get a job anywhere else but the Government. (And I’ve seen my fair share of those folks!) Consequently, when it comes to situations like the current one with Agility, the Govt can’t respond quickly enough to get out new RFPs, so they must extend the current contract whilst that happens. In this case, Agility benefits from the Govt’s lack of nimbleness and adeptness. By the way, the money’s not being “wasted” as the writer above states … the money would be spent on someone else (if there were someone else), if not on Agility … someone has to continue doing the work on the contract—that doesn’t stop just because of the Grand Jury ruling.

    Here’s a plea out to the folks who post here: stop trying to see something evil or no good in everything you look at when it comes to defense contractors/defense contracts. The majority of these companies want to do well … care for the American military … care for this Country. Yes, there are some bad apples, and the companies do pretty well in identifying those guys/gals and getting rid of them. (In fact, many of them are currently serving prison time due to their companies having turned them over to law enforcement officials.

    How about “giving it a break” … look at the real story – dig out the real truth—instead of taking the lazy way out and condemning contractors with a broad brush? It’ll take a little more work than what you’re doing now to ferret out the real “bad guys,” but you’ll be doing yourself and those who read your blog a real favor.

    The tax payer money is treated like monopoly money by the government and the contractors that they hire. When companies like KBR and Dyncorp get audited and have to return millions of “accidentally misplaced” money they get a little slap on the hand & the get out of jail free card. Once they get out of jail they get to round the board and collect their $200 ( BILLIONS of the tax payers money that they can again misuse).

    Why does this happen over and over again? What is our government doing? I would like to see Claire McCaskill make a difference because she was an auditor. We will see if she can flex her muscle.

    KBR, Dyncorp and Agility are all being audited with clearly some obvious fraud and they are being rewarded for it! Who will get the next AWARD???? Stay tuned..

    FYI. Reuters is now (April 9) reporting Agility has settled with the USG for $600M just in time to be evaluated for the new PV contract. Although the evaluation is in its last stage with award imminent, I believe the USG will now start officially reviewing the Agility proposal to compete it against all other bidders. I also believe that the USG has been evaluating their proposal all along while they were suspended, which is illegal, just so that they would be prepared for this scenario. Now watch the USG miraculously award the follow on contract to Agility. Obviously protests are already being composed by all the other bidders. This should be interesting.

    Who has the the lowdown on the current DDKS proposal evalutaion? I expect Agility and KGL bid on the contract, but are there any other bidders out there? I saw the USG removed the proximity clause to Camp Arifjan, but I find it highly doubtful anyone else in Kuwait can provide the 800,000 square feet outdoor and 700,000 square feet indoor requirement. Agility’s still ineligible due to their 6 criminal indictments, so this contract may essentially follow the sole source decision and be awarded to KGL. Ironic how the USG cancels the SSN to KGL, takes an additional 6 months to evaluate full competition proposals, then may ultimately award the contract to KGL. Essentially this process allowed Agility, a suspended contractor, an additional 6 months of profit. Lovely.

    Anyone care to contribute their insight into the discussion?

    Last week Agility sold nearly 1,000 of its Heavy Lift VI trucks to a member of the Kuwaiti Parliament. Can you say massive liquidation?! This week sources informed me that Agility plans to move forward with litigation versus settlement talks with the USG. I wonder if Agility is also looking for a buyer for its ~800 refrigerated trucks that will be available once the Subsistence Prime Vendor contract expires at year’s end. If Agility is serious about going to trial, then the DDKS will most likely be awarded to KGL come August.

    One caveat: this may also be a ploy by Tarek Sultan to generate cash by selling assets, then settle with the USG, then re-enter the DoD marketplace with new assets. Who knows?

    If Agility is unwilling or unable to settle, DDKS should be a lock for KGL. Due to the earlier sole source award to KGL, it’s clear the USG deems them capable of providing the required indoor and outdoor storage. Intel suggests KGL is building massive warehouses on their Mina Abdullah lot to accommodate the increased demand. Can anyone confirm the new construction? I’ll try to drive by this week and gather the facts. Did KGL bid on DDKS alone or did they partner with someone? Award is scheduled for August 31, but I wouldn’t be surprised to see it announced around August 1. Trading of KGL stock has been flat for several weeks, but I expect it to pick up as the award date grows closer. Pay attention to buyers purchasing large lots of stock.

    I’ve seen major construction occuring at KGL’s Mina Abdullah site for a few months now. Looks like multiple large-scale warehouses on the south side of the complex being erected. Hmmm…do they know something we don’t? I think it’s safe to presume that they are expecting a flood of new business in one form or another. Back in April the speculation was the award of Prime Vendor, now it’s DDKS. Has anyone heard about the status of the protests on SPV? GAO wouldn’t actually overrule the initial award to Anham and give it to KGL, would they? Now that’s crazy talk! Whatever the result, KGL is expecting something BIG to invest millions of dollars in constructing new warehouses in this tough economy.

    Anyone with KGL insider information? Do tell.

      The USG will be conducting DDKS site visits in June/July as per the solicitation. No word of the exact dates the USG will visit the bidders’ locations (KGL? Agility? other?). Considering the lack of viable competitors, I bet we’ll see the site visits occur very soon and an award earlier than the scheduled August 31 date. My bet’s on KGL as Agility is ineligible. Your intel about KGL building several new warehouses in Mina Abdullah is a good indicator of their expectations of this award. Would love to pick KGL’s brain!

I guess that’s as it should be. No leaks. What about the site visits from July and thereafter. Is KGL still the frontrunner?

    Did your companies bid on this contract and/or have you heard of anything regarding the status of this evaluation? I receive regular reports that Agility continues to lay DDKS workers off and refuses to allow them to leave immediately in fear they may transfer to the new contract awardee. Agility prefers to pay out the 90-day notice period and make it more difficult for their competition.

      My sources say Agility is pouting because the USG did not take their buy-off to continue with business as usual. Those warehouses could also be something to do with KGL trying to get an updated bid on the Anham award.

      Let’s look for the modification that will bring back the sweetheart 5% award fee for DDKS and take the contract for 4 to 6 years.

        What does anyone hear about the Mail Porter contract that was going to be single sole sourced to NAS (also suspended since Nov 2009) by the Air Forces’ TSgt Wakefield and MAJ McCabe? The DLA attorney who wrote their suspension letter was astounded. This was clear violations of Federal Laws that we have. There are 70 + companies that could have performed that contract.

        So, for all of you who could have bid on this. Maybe there will be a shot at it.           The Air Force was caught and it is apparent that the GAO will cover up for the criminal activities of both the U.S. Army and the U.S. Air Force.

          TSgt Wakefield’s explanation was that no other company could perform this. Corruption in Kuwait is pretty well ingrained, but what was the TSgt’s incentive to 1. award to a suspended company and 2. Why didn’t she open the solicitation to competition and 3. Where, as in the case of DDKS – is the signed Justification and Approval. Major McCabe being replaced 10 days after the filing of the GAO protest probably is just the start for what will be happening at Vandenberg AFB where this contracting team who don’t follow the FAR come from. Next ?

        Since the USG didn’t deny KGL’s SPV protest, but simply dismissed it and is now forcing “amended bids”, the contract is “up for grabs” much like the KGL Chairman announced a few weeks back. Anham made huge assumptions in regards to force protection (expected waivers) and pallet positions (expected USG estimates were too high) based on the protests available via FOIA. The GAO simply allowed DSCP to save face by not sustaining the protest, but is now forcing them to accept amended bids from the parties.

        Any timeline on when the amended bids are due and when the new contract will be awarded?

        Is it your understanding that based on USG acquisition regulations, Anham’s previous award must be cancelled due to the amendeded bids from competitors. I’m sure Agility loves the delay (millions more $$$$$), but would roll over in it’s grave if their hated rival KGL is awarded the billion dollar contract.

          I was talking about Agility’s affiliate NAS that were going to be single sole sources the Mail Porter contract by Vandenberg’s 386th ECONS TSgt Wakefield and the now removed Major McCabe.

          Notice how that solicitation is no longer on FBO.

          The GAO obviously are in my experience another accomplice of U.S. Army criminal contracting activity. The decisions are biased and usually without fact.

          The GAO even dismissed a protest when the Air Force were obviously breaking Federal Laws to cover-up for the Air Force. I can only memorialize it and hope that some day a good reporter adds up the evidence and writes a story.

          I think Anham was awarded and the award should stand. KGL can ask to be a subcontractor and I am sure it will work out just fine. Why should the DLA reverse cour$e unle$$ of cour$e someone has gotten to them. : – ) savvy ?

            I found the Mail Porter notice archived within FBO, but still no word from the USAF as to its new status. Will this be competed or not? Tell us TSgt Wakefield and MAJ McCabe!

            Also, what’s the latest on DDKS? Award is scheduled for 31AUG, but I haven’t heard a word from anyone since the end of June when the USG conducted site visits. Obviously KGL is the frontrunner, I think you mentioned your company was interested and/or capable, but who else is out there? Where are your facilities located in Kuwait? Agility was extended on PV due to the amended bids required from Anham and KGL, but do you think the USG will also extend Agility on DDKS? As of today, the USG plans to completely transition out of Agility’s DDKS facility no later than the end of February 2011 and into the new awardees’ facilities. Based on the six-month timeline, I’m sure the new DDKS awardee is preparing for the incoming material as the USG will start September 1, 2010.

        A little birdie just told me that the DDKS evaluation has concluded and the awardee has been selected and unofficially notified. Shall we take this to mean the USG is actually going to meet the August 31 scheduled award date? I assume this means KGL has this one in the bag. Anyone care to contribute confirmations or rebuke this intel?

    Hello Everyone! It’s been a long time. In follow up to my June post about KGL’s construction, yes, I drove by in late July and verified two new LARGE warehouses erected on the southern end of the KGL lot in Mina Abdullah.

    Like Quicksand, I too haven’t heard anything new about the DDKS contract or award. I guess we’ll all hear who is the fortunate bidder in a few weeks. With Agility still suspended, my money’s still on KGL. As far as I’m aware, no one else in Kuwait can come close to providing the indoor/outdoor space AND the past performance of 3PL distribution and depot operations.

      Is the Iranian affiliate on the EPLS. It wouldn’t matter – the U.S. Army and Air Force don’t pay attention to that.

      The Air Force will be dealing with the Iranians before KGL does and I think the delivery will be out of the bottom of an aircraft.

        One of the amendments to the Iran Sanctions Act that had KGL running to Congress. Any connections with any contractor doing business with Iran can be reported to the US treasury or ask your Congressman to write a letter to OFAC.

        New certification requirement for government contracts
        The new act mandates amendment of the Federal Acquisition Regulation to require each prospective US government contractor to certify that it does not engage in activities sanctionable under the Iran Sanctions Act. The prospective contractor must also make the certification as to any person that it owns or controls. This requirement may be waived by the president on a case-by-case basis. Subject to certain exceptions, contractors found to have submitted false certifications will have their contracts terminated or will be ineligible for federal contracts for three years.

        Expanded parent liability
        The new act effectively expands parent liability under the Iran Sanctions Act. Currently, a parent entity is liable under the Iran Sanctions Act if it knowingly engaged in the sanctionable activities of its subsidiary. Under the act, if an entity owns or controls another entity that engages in activities sanctionable under the Iran Sanctions Act, that entity is also liable under the Iran Sanctions Act if it knew or should have known about the sanctionable activities, regardless of whether it participated in such activities.

    My thoughts are 0% considering they just went to Washington to grovel for their lives after Congressman Sherman and Klein caught them with their hands in the cookie jar with a SDN proliferator Val Fajr a subsidiary of IRISL.
    Seems DOD gave them a message…no contracts until you have no IRAN…
    That may be a little hard considering all of their Iranian ties….Combined Shipping is not the only one…
    Heat is high …they may just get themselves burned.

      FYI. It’s not illegal for an American or foreign company to have business ties with Iran. The sanctions only affect certain business relationships and areas of industry. Simply ferrying people back and forth from Iran to the UAE and back doesn’t break international sanctions. Is this ferry even operating anymore?

      I’d wager an 80% probability of KGL winning this contract due to the lack of legitimate competitors, KGL’s new warehouse construction, their existing facilities, and their experience. Award scheduled August 31.

      After the sole source intent was cancelled, the contract is being competed with “full and open competition”. Credit to Keven!

      The USG conducted site visits in late June. If the USG hasn’t selected a unofficial, preliminary vendor or been left with only legitimate vendor (KGL?), they sure haven’t revealed it. One must assume the USG is in contract talks and is conducting preparations for this massive move out of Agility. Can you imagine the assets (MHE, transportation, warehousing) and the highly skilled IT and 3PL staff required to fulfill this mission? Crazy!

        KGL did what no one else wanted to do. Build new warehouse space and not too far away from current DDKS. Ok, everyone who wanted to have a shot was able to bid.

        Where is Kharafi’s new warehouse ready for the DLA inspection.

        Anham should have one just to meet their obligations and I think they have their hands full already.

        Agility – I am waiting for the story about the USG dropping the Qui Tam from AP, BBC, CNN, any decent source ……. but nothing.

        What about the 5% award fee – do you think it is going to come back on in an amendment ? Gift from Uncle Sam?

    KGL already starts recruiting people in technical and operational fields and they are issuing letter of contingent to ex KBR and Agility employees looks like they have received green signal from USG.
    Kharafi has no experience with USG and Anham they dont have any office in Kuwait.
    MY bit to KGL 99.9%

      Maybe KGL will hire Keven after they win DDKS and Heavy Lift so they can stay out of trouble. ;) The next 2-3 months will be interesting to watch. Even with Ramadan upon us, I think we will see both stocks continue to climb significantly. After KGL is awarded these massive USG contracts, I predict Agility’s stock will falter shortly thereafter.

    IT looks that KGL going solid to win the PV, specially they are being preparing as a winners, 107 Agility drivers transferred to KDL, KGL and Anham, most of them to KGL.

    Freedom Troops want to eat, and they will not wait Anham or KGL, Agility can provide the hot fresh meal in these days, So hear that, an extension of PV with Agility to Dec 2010.

    in other hand Agility Financial Results for Q2, 2010 looks great, I wonder why?

    Regarding Iran thing, guys please see the big image, a soldier wants to eat,no one will care who deal with Iran, Agility was contracting with an Iranian company to repair its fleet [Trailers], where was the fears to plan a bomb into the trailers? see its the food power, no matter the legal, price, politics have to say.

      Yes, KGL will be the new DDKS contractor. Award scheduled for August 31. Let’s see if DLA can stick to their own schedule. I would love to be the moving company for this transition, although it’s only across the street from Agility’s facility.

      The DDKS contract is a base year plus 3 x 1-year options. Despite the drawdown of Iraq, the DDKS facility is and will be an enduring facility to support all CENTCOM operations (Iraq, Afghanistan, Yemen, etc.) that will exist for many years to come.

    Does anybody tell when the USG/DLA is going to announce the DDKS award? normally DLA Declares the new contract before / days from the anticipated date. What happened to DDKS why the DLA is waiting for last moment.

    This is the USG. USG provided award dates, along with just about every other date they release, is only an estimate. Give it a few days….maybe even a week.

    Great I dont thing its going to finalized in a week, as they already extended to agility for six months now they have enough time to release the result. It may took a month i guss. lets see.

      Agility has been known to pay some of the highest wages at all levels, but I hear KGL pays competitive wages too. This is a market economy. If workers don’t want to work for less money, then they can go to another employer paying more. Isn’t that what most of us have done? Yes, as western expats we may have more experience, education and opportunities, but the principle remains.

    KGL people! KGL! Verified Anham and Kharafi didn’t bid on this solicitation. so guss how will be the next fortunate bidder “KGL”.based on the followings:
    1) KGL meets the indoor and outdoor warehousing requirements and no other company has the requied facility except KGL and Agility.
    2) DLA awarded DDKS to KGL on single source basis in Feb 2010 but later on they cancelled as USG wants full and open competition.
    3) They have proven past performance to serve the USG in different project.

    only question left when we are going to hear from USG about their decision, i hope in coming next week.
