KBR responds to ex-worker’s gang-rape claim

HOUSTON—A woman claimed she was gang-raped in 2005 while working in Iraq for the Houston-based company , but the company said those allegations are not true.  said she has been waiting for years for her attackers to be punished.

“I know I was drugged, I know I was raped,” she said. “And I have suffered for four years trying to get my day in court to be able to face the corporation that allowed it to happen, and my perpetrators.”

KBR is disputing Jones’ claims. They said she was a willing participant in the sex act, and they said the incident only involved only one man.

The company referred to the testimony of a KBR firefighter who said he had sex with Jones the night of the alleged assault. In an e-mail sent to 11 News, KBR said, “The firefighter admits that he and Ms. Jones had consensual sex. However he is certain that nobody else was present or had sex with Ms. Jones that night.”

Jones said the sex was not consensual and claimed she was bruised and bleeding after the incident.

Jones and her lawyer said KBR took a kit from a doctor who examined her, but they question the way it was handled.  KBR said there was no foul play in regards to the kit.

“KBR has signed a chain-of-custody receipt showing that the sealed rape kit was turned over to the State Department. KBR has no knowledge of the contents,” a company statement said.

11 News contacted the State Department to find out if it does, in fact, have the 4-year-old rape kit.

They replied, “The rape kit is being stored in accordance with the U.S. Department of State standards.”

The case has now switched investigators. The Bureau of Diplomatic Security that conducted the investigation said they’ve turned the case over to the Department of Justice.

In 2008, three years after Jones said she was assaulted, a U.S. attorney presented the case to a grand jury.

Jones testified before the grand jury, but no one was indicted.

Now Jones is seeking her day in civil court.  She sued KBR. Her lawyer claimed the company created the atmosphere that led to her attack.

“So what they did was they brought an unknowing victim to frankly a bunch of jackals who took advantage of the situation,” said Jones’ attorney, Todd Kelly.

KBR argues the matter can’t be handled in court because Jones is bound by her employment agreement that states all disputes must be handled in arbitration, privately.

A panel of the Fifth Circuit Court of Appeals has ruled in favor of Jones, but now KBR is asking that the case be reviewed by the entire Fifth Circuit.

Through it all, Jones has shown determination and patience, but for now her battle isn’t over.  It appears arbitration or a trial is a long way off.

‘Burn pit’ lawsuits land in Greenbelt

A raft of lawsuits filed across the country by soldiers and contractors who say they were sickened by “” in Iraq and Afghanistan have been transferred to a federal judge in Maryland.

The suits against Halliburton Co. and its former subsidiary, Inc., allege a variety of waste — from batteries to medical detritus, including human remains — was tossed and torched in huge, uncovered holes near army bases.

The plaintiffs, who hope to become a class of thousands, say the hazardous smoke from these sites caused ailments from rashes to upper respiratory problems to cancer.

Some of the 22 suits also allege the defendants did not properly treat water or provided substandard food.

“It was their obligation to do this in a safe manner, and they didn’t do so,” plaintiffs’ attorney William T. O’Neil said in an interview Tuesday.

His Washington, D.C.-based firm, Burke O’Neil LLC, filed all 22 of the cases and did not object when KBR sought to have them transferred to U.S. District Court in Greenbelt for pretrial management.

The Texas-based defendants acted “egregiously merely to make more money for themselves,” O’Neil wrote in the suit originally filed in Montgomery County Circuit Court in January.

In an e-mail, a KBR spokeswoman said the “general assertion that KBR knowingly harmed troops is unfounded.” (Read the rest of the story here…)

DoD Opposes Franken’s Anti-Rape Amendment

It would appear the Pentagon wants US civilian contractors to risk their lives to support our US soldiers. But in return the Pentagon doesn’t want to support our US civilians. This was made clear when the Pentagon opposed the Al Franken Anti- Amendment!

“The DoD opposes the proposed amendment,” reads a message sent from the White House to the Senate on October 6, the day the amendment passed by a 68-30 vote.

“The Department of Defense, the prime contractor, and higher tier subcontractors may not be in a position to know about such things. Enforcement would be problematic, especially in cases where privity of contract does not exist between parties within the supply chain that supports a contract,” reads the DoD note. “It may be more effective to seek a statutory prohibition of all such arrangements in any business transaction entered into within the jurisdiction of the United States, if these arrangements are deemed to pose an unacceptable method of recourse.”

A White House spokesman said that the DoD opposition is overstated in the message sent to Congress. “We support the intent of the amendment, and we’re working with the conferees to make sure that it is enforceable,” said spokesman Tommy Vietor when asked about the DoD statement.

Sens. Saxby Chambliss (R-Ga.) and Johnny Isakson (R-Ga.) both provided statement to the Sun News in Macon.

“This would be a major, fundamental change in U.S. labor law and I believe it would be very detrimental to employees to eliminate arbitration as an option,” Isakson said. According the The Huffington Post, this statement inaccurately portrays Franken’s amendment: Employees would still be able to elect to use arbitration; they simply wouldn’t be forced into it.

Chambliss added, also inaccurately according to HP: “If that happens, these employees’ only recourse will be to litigate suits in court, which is a very lengthy, expensive and time-consuming process.” (click HERE to read this entire article at The Huffington Post)

There is not doubt in my mind the Pentagon opposes this Amendment. I’m sure they fear having their dirty laundry aired in a public court! They would love to see it all kept behind closed doors.

Senator Franken pulverizes de Bernardo

If you just hate attorney’s and everything they stand for then this video is for you!! I’m not sure how I missed this hearing! So many hearings….so little time. But, on October 7, 2009 The Senate Judiciary Committee chaired by Senator Patrick Leahy (D-VT) held a hearing on “Workplace Fairness: Has the Supreme Court Been Misinterpreting Laws Designed to Protect American Workers from Discrimination?” Wintesses were among others KBR victim and former KBR employee and Mark De Bernardo KBR arbitration attorney :( (Yuck!!) In typical Senator Franken style he just chews up de Bernardo!! Well worth the watch! There must be a special place in Hell for KBR attorney’s.

Before I start slamming KBR in typical “Ms Sparky” style, I just want to clarify I know there are a lot of qualified hard working good people working for KBR in Iraq and Afghanistan TRYING to support our troops the best they can. The problem is they are being led by unqualified, short sighted idiots. With that in mind let the slamming begin.

I find it interesting that KBR is advertising in Washington DC. Are they finding the customer is a little miffed with them?? Are KBR and the DoD on the outs…..one can only hope!

Let’s start with clean water. Are you talking about the water contaminated with micro-organisms or the water contaminated by chemicals like Camp Kalsu.

Are you talking about the poorly constructed and maintain housing and AB units?

Are you talking about the electrified showers? Or the water heaters that blow up?

Are you talking about the burn pit exposures? Or the chemical exposures like ?

Are you talking about the over charging? Are you talking about the serious abusing of your own employees?

There just might be some soldiers out there who are thinking it’s not such a good idea to have KBR with them “every step of the way”.

KBR….the end does not justify the means. You can’t just do what you want and then chalk it up to “it’s a war zone”! Our soldiers deserve better than that!

I hope you are not charging the US taxpayers for this ad campaign!!

Bill Bodie in the KBR litter box…..again!

william-c-bodieIn typical Bill Bodie style…..he issued ANOTHER whiny editorial to a newspaper in the jurisdiction and might I add jury pool of the West Virginia National Guard. The same National Guardsman who have filed suit against for knowingly exposing them to at in Iraq in 2003. Bodie pulled this same shit in Pittsburgh when he sent an editorial about how KBR was not responsible for the electrocution death of SSG Ryan Maseth. (click HERE) He has to send editorials because the main stream media doesn’t take KBR statement seriously. Bodie wasn’t even working for KBR when this happened. He didn’t start working for KBR until March of 2005. So anything he has to say is hearsay at best. Just another pathetic attempt by Bodie to cover up KBR shit in the KBR litter box. He is turning in to quite the KBR “bobble head” doll. Maybe KBR could market Bill Bodie and Heather Browne as a set!! I guess I am going to have to add a new post category called “Bodie’s Bull Shit” or “More Mindless Drivel” I haven’t decided.

William C. Bodie: KBR handled Iraq site (Qarmat Ali) safely

CHARLESTON, W.Va. — As the old saying goes, everyone is entitled to their own opinion, but not their own facts. Recent media coverage on lawsuits filed against KBR alleging military personnel were sickened because of long-term exposure to sodium dichromate at Qarmat Ali, an Iraqi water treatment plant, has been so erroneous that it is time to set the record straight.

It is important to understand that the chemical in question — sodium dichromate, which is used as an anti-corrosive agent in industrial enterprises, was left behind at the Qarmat Ali plant by Iraqi staff upon vacating the site in the wake of Saddam Hussein’s overthrow in 2003. No remedial action was taken to clean up the site prior to KBR’s arrival in support of U.S. forces. KBR was not hired to do an environmental assessment of the facility and was told the site was free of environment hazards prior to starting work.

One erroneous assertion is that KBR discovered the presence of sodium dichromate at Qarmat Ali and took no precautionary action. In fact, immediately after we became aware of potential contamination from sodium dichromate in the plant, KBR began working with the military to conduct air and soil testing at the site and posted signs in English and Arabic to advise of the presence of the chemical. In October 2003, The U.S. Army Center for Health Promotion and Preventative Medicine issued a report noting that KBR effectively minimized exposure at the site.

Moreover, the U.S. Army Center for Health Promotion and Preventive Medicine conducted extensive testing on military personnel who were stationed at the site to determine any exposure levels. The testing showed that no troops were harmed and that they were unlikely to develop future injury from any limited exposure they received while in Iraq.
The results were further reviewed and confirmed by the Defense Health Board of the Department of Defense. The British military reached similar conclusions regarding their own troops. KBR’s testing also found no measurable exposure and no indication of injury. The troops were on the site an average of 18 days, and the scientific literature indicates that this amount of exposure is insufficient to cause long-term health effects. There is no evidence linking any injury to chemical exposure at the water treatment facility.

KBR remains committed to a fact-based dialogue on this issue. We will also continue our historic practice of working fully and cooperatively with the government on this matter.

Since 2003, KBR has supported the U.S. military in Iraq, providing life-support services such as meals and laundry and mail service to our troops. KBR remains proud of the work it performs and we intend to continue our vigorous defense on this issue, on behalf of the more than 50,000 dedicated employees who work tirelessly for KBR in Iraq and Afghanistan at great sacrifice to themselves and their families.
