Politics make strange bed fellows but Cornyn and Inouye - Bipartisan Friends Forever?

Apparently Government Contracting is the last bastion for snake oil salesmen to ply their trade. It appears that 30 Senators want to maintain this status quo, even if it means blocking victims of violent crime from seeking justice. The mere fact that legislation had to be drafted to protect employees from companies, that do business with the US Government, both in the US and overseas, is in itself reprehensible but the fact that elected officials voted against the amendment is even more disturbing.
Meanwhile the Subcommittee on International Organizations, Human Rights and Oversight held a hearing, October 21, 2009 on “International Violence Against Women: Stories and Solutions.” How can we expect to lead this effort on a global scale when we cannot, or will not, protect our own citizens effectively? It appears that our moral compass needs to be replaced or at the very least recalibrated.
While some columnists seem to deem this as a partisan attack against 30 Senators, it is clearly a non-partisan guilt fest. The list of elected officials and government organizations that have failed to act or follow through is long. Here are a few:

The letter omitted some important facts.
I opposed this amendment prompted by the Jamie Leigh Jones case for many of the same reasons the Obama administration did.
First, the rape allegations in the Halliburton case were not subject to arbitration (according to Jones v. Halliburton, U.S. district court), so citing them as the reason for passing the amendment in the defense appropriations bill is misleading.
Second, the amendment is a blatant attempt to benefit trial lawyers. It effectively bans defense contractors and subcontractors from entering arbitration agreements. Arbitration greatly reduces litigation costs for employers and employees while ensuring victims are fairly compensated by streamlining the litigation process and limiting lawyers’ fees.
I sympathize greatly with victims of rape and have voted repeatedly to increase sentences for the perpetrators of such heinous crimes.
Liberals have claimed senators who voted no are pro-rape. That is ludicrous. Attempts to manipulate the tragic events in the Halliburton case to line the pockets of the trial lawyers are disgusting.

Well, Senator Cornyn if this amendment is not a viable solution, what do you suggest? First before you answer keep in mind that I will be weighing your response based on these facts:
- Your home state is Texas, which you were elected to represent and that includes Jamie Leigh Jones.
- It was fellow Texan and Congressman Ted Poe that initiated the rescue of Jamie Leigh Jones from Iraq, while both you and Texas Senator Kay Bailey Hutchinson remained silent and made no effort to assist in her rescue. By the way rescuing a constituent from life threatening peril is not a spectator sport.
- Approximately 53% of the the registered voters in Texas are women. The stats on how many you have alienated with this vote are not available yet.
Senator Cornyn, your letter also omitted some important facts about the Franken Amendment. It explicitly bars contractors that force their employees into binding arbitration for cases of sexual violence, acts of violence and where the employees basic civil and human rights have been violated, it does not ban arbitration as a means for employers or their employees to seek resolution to a dispute should both parties agree to arbitrate the issue.
In the spirit of Bipartisanship let’s take a look at Senator Dan Inouye. In recent years, Inouye has become known for his ability to bring federal money to his home state, and he even declared himself “the No. 1 earmarks guy in the U.S. Congress” in August.
“Inouye either will get the amendment taken out altogether, or water it down significantly. If they water it down, they will take out the Title VII claims. This means that in discrimination cases, they will still force you into a secret forced arbitration on KBR‘s (or other contractors’) own terms — with your chances of prevailing practically zero. The House seems to be very supportive of the original Franken amendment and all in line, but their hands are tied since it originated in the Senate. Senator Inouye will be up for re-election during the 2010 mid-terms and this would be an excellent time to let him know how the public feels about giving corporations preference over the citizens of the US.

In October 1992, Republican Senate nominee Rick Reed began running a campaign commercial that included a surreptitiously taped interview with Lenore Kwock, Inouye’s hairdresser. Kwock said Inouye had sexually forced himself on her in 1975 and continued a pattern of sexual harassment, even as Kwock continued to cut his hair over the years. Inouye, seeking a sixth term, denied the charges. And Kwock said that by running the commercial, Reed had caused her more pain than Inouye had. Reed was forced to pull the ad, and while many voters took out their anger on the Republican, Inouye was held to 57 percent of the vote – the lowest total of his career. A week later, a female Democratic state legislator announced that she had heard from nine other women who claimed Inouye had sexually harassed them over the past decade. But the women didn’t go public with their claims, the local press didn’t pursue the story, and the Senate Ethics Committee decided to drop the investigation because the accusers wouldn’t participate in an inquiry.

I have to respectfully disagree with your sentiments against my Senator John Cornyn.
He wrote to the DOL 2 days after my writing him last October. Within 1 day of his writing them, I had an informal conference scheduled. He has followed up numerous times to ask about my DBA case. He is an honorable man who happens to not agree with that liberal basketcase Al Franken.
It is not all black and white, Frankin’s amendment is not the end all be all answer to our legal woes. Being able to sue KBR will not get justice for this girl (if she actually was attacked).
I have read about a woman who did not pursue charges after she was attacked in theater and she claims that Jaime stole some of her evidence and used it as her own. There is still no solid proof that Jamie was violated over there. And the way they keep talking about her being locked in a “shipping container”, hell we all lived in them!
To single out this supposed attack to justify changing the “binding arbitration” is wrong in my opinion. It should be abolished from all sorts of businesses that are using it now, not just from a woman who wants money. And yes, that is what I am saying, Jaime wants money. This whole thing boils down to that.
Arbitration does unfairly favor the company that is sponsoring it. The arbitrators know who pays their fees. If they bite the hand that feeds them, they will not be picked again so the overwhelming majority find for the company. If you look closely at your bank accounts, stock broker accounts, and credit cards you will find “binding arbitration” agreements hidden in the fine print. It is not like these contracting corporations are doing anything unique.

Wow….I don’t know where you get your facts….but one good deed on your behalf by Cornyn does constitute an honorable man. And I think if you have all this additional information about the evidence in Jamie’s case you need to come forward. I can forward your contact information to the Justice Department. And being held anywhere against your will, even by KBR is kidnapping. I wasn’t there so I don’t know if Jamie was raped or not. But, I know very very few women who would consent to sex that leaves them battered, bruised, bleeding and in need of reconstructive surgery. And just in case you were unaware. If you are drugged and can not consent it is rape!

Mark, What you are referring to is Letty Surman’s affadavit that supports the general atmosphere toward women, it is not evidence and it includes references to Ms Jones and was not “stolen.” Letty Surman writes, “During my time as an HR supervisor, I was aware that a lot of sexual harassment went on—it was our major complaint … I am aware that Halliburton has a policy of sweeping problems under the rug.” Army doctor, Jodi Schultz, M.D that examined Ms Jones supports her claims of assault.

I personally believe that from a “Moral” point of view – any parent, brother, sister, or concerned citizen would never want their loved one raped, by one or many, therefore it is my belief that the lobbying forces have gotten their blood sucking tenticles into the most corruptible of the elected officials this country has to sit on such a high and laufty position.
If these elected officials don’t start doing the morally right thing – an uprising from the suppressed multitudes will occur. These politicians are so blinded by their self elevated pressence in our lives that they are only seeing the ‘WHAT’S IN IT FOR ME” attitude.

My only problem with this theory is that not one of these legislators have brought forth an alternative solution and not one of them made any comments until this grew into an international incident and they felt they needed to come forward & CYA. Another article came out today and Ms Jones court battles for her right to sue apparently are not over. KBR is in fact still trying to force her into arbitration according to the article. Everyone has a right to their opinion and if Ms Sparky’s and my opinions upset you so, perhaps it would be better for your blood pressure and overall health to not read this blog. After all I am sure that Senator Cornyn will need all of his loyal supporters healthy enough to vote, the next time he runs for office.

I am 60 yrs. old and am not considered old by many, but I feel much older now with injuries from Iraq and dealing with AIG. I have seen this country change from a Flag waving, Church going, Pledge-of-Allegiance quoting, to cover our hearts when the U.S. Flag is carried by us in a parade, to when you go into court and a Judge doesn’t swear in a witness with the words “SO HELP YOU GOD”. This country is allowing those that have no faith in a higher being other than the $$$$$, to run this Great Land into the ground – right under our noses, and so many are blind to this. Do we want to wake up one day and find ourselves living out a NIGHTMARE like situations that we have only watched in a Hollywood Movie?
I realize that what I believe to be right and just, may conflict with what you may believe is right and just – but we all live in this country and we must, we have to stand up for what is right or we will be a Third World Country some day. I am utilizing the right of FREE SPEECH guaranteed to all of us under the Constitution of the United States. I don’t want to lose this or anything else. I was just giving my opinion, not trashing a rape victim. I NEVER trashed a rape victim, I only questioned the whether the incident occurred as she describes it. No one one knows quite what happened, that IS a responsibility of the court system.

Read the story below. I STILL believe this woman over Jamie Jones. She was only in Iraq for less than a week. This woman was there for a year. Jaime Jones is a thief and a liar out for money!
Tracy K Barker Forgotten Rape Victim Prepares for Arbitration
Tracy K Barker, A forgotten Rape Victim of many horrific crimes committed against her while working as a contract employee for Halliburton/KBR had decided in 2004 to work over seas in support of Operation Iraqi Freedom and would become the sole support of income for her household when her husband retired and her mother in law had also fallen ill. At the time of her decision Tracy was and still is an Army dependant married to 1st Sgt Galen D Barker active duty 25 years and is now a mother of five. Still fighting for justice for herself and other victims after four years she prepares for arbitration, a ruling that was handed down by Judge Miller of Texas based on what little facts, details and evidence were and were not submitted to the courts.
Tracy also witnesses an Iraqi Woman being choked and threats that her supervisor in the city of Baghdad Camp Hope also known as The Green Zone came from the same supervisor. Tracy filed a complaint about her work conditions in the procurement department and copies were given out to her manager Tracy was retaliated against.
Jones has claimed she worked in the procurement department and this incident ofcopies of the report happened to her in her pleadings. Jamie Jones has never worked in Procurement department she was an IT Tech in another area which was not even located in the RSO building.
In Jones complaint they have claimed that Tracy was assaulted by State Department employee in the barracks this is another lie they have claimed this happened to Tracy and then Jones was put days later in the same room his is a lie. Tracy was never assaulted by Ali Mokhtare in Baghdad Green Zone or in any Barracks the photos they stole of animals and Billeting Motto never came from Baghdad Green Zone or any where Jones has ever been.
They also filed false pleadings to promote Jones case that Tracy was assaulted in her bedroom by mokhtare while discussing employment opportunities which is another lie. Tracy was assaulted while checking housing and during work in Mokhtare’s quarters.
In retaliation of reporting the incidents Tracy was locked in her living container for three days and, watched as she used the bathroom. Again this happened in the Green Zone in Baghdad.
Tracy was then transferred to Basra in March of 2005, the sexual harassment started once again but by another perpetrator. As she tried to settle into her new office pornography of animals having sex and prostitutes, and Billeting Moto “We Do Anything to Get You in Bed” Posters displayed throughout the offices, as well verbal sexual content continued on a daily basis.
Way too much to bare Tracy reported this conduct to Halliburton/KBR Human Resources Manager Letty Surman who was in Kuwait in fact Tracy Barker submitted an affidavit of Letty Surman to Congress which depicts Basra conditions before Tracy arrived and during the time she was there in 2005 where Letty Surman was the Human Resource manager over Basra at that time. Jones has claimed Letty Surman was her human resource manager in Baghdad and even submitted an affidavit of Tracy with Tracy’s names removed from the events of Basra including description of Tracy’s coworkers and office. Letty Surman has never worked in Baghdad Green Zone or anywhere Jones has ever worked Surman stayed in Kuwait until the winter of 2005.
Upon Tracy’s return back to Basra Camp with the help of a British Soldier after 19 hours of abandonment in the Iraqi Desert Tracy discovered all of her items missing and in fact the same driver that left her in the desert had actually stolen her personal items and furniture.
As Tracy continued to endure sexual harassment and continued to report this behavior one evening a State Department employee by the name of Ali Mokhtare sexually assaulted Tracy as she fought him to keep him off of her. Escaping the horrific incident in Basra Tracy had reported this to management unfortunately the ones she was reporting to on the Basra Camp was the same managers that were sexually harassing her. Tracy was then forced to wear the same clothes and paraded in the lunch hall, in spite of following every demand Tracy was still denied access to a phone and access to medical care.
Sgt Kevin Rodgers has signed a sworn statement to this account and more including the fact that he had given a cell phone for Tracy to use at this time to call her husband and has also submitted another sworn affidavit indicating that he never knew nor helped Jamie Jones and in fact he was not even in Baghdad but yet Jamie Jones still submitted the original statement of Kevin Rodgers as if it was her own evidence. claiming Kevin Rodgers affidavit is describing the Baghdad Barracks where Jones claims she was assaulted which is a lie Rodgers was in Basra and eye witness to Tracy and has never worked or been stationed any where Jones has ever been. They stole Rodgers eye witness statement of Tracy in Basra Iraq and gave it to Jones to claim as her own to promote herself in the press in 2007.
Tracy was also confined once again in a living container for three days.
Dr. Pakkal David happened to get stranded on Camp Basra and became aware of Tracy’s condition immediately. After speaking with Tracy Dr. Pakkal decided to over ride Halliburton’s intentions on continuing to remove her from the convoy manifest preventing Tracy from leaving to go home. Dr. Pakkal would help Tracy leave Camp Basra.
The night before Tracy was to leave Tracy fell asleep the following early morning Tracy awoke to one of the men that had been sexually harassing her all this time was rapping her Tracy cried and screamed and ran out of her living container leaving all of her belongings behind.
All of these facts, evidence and a chance to testify to congress on two separate occasions have been stolen from Tracy and even now Tracy remains a forgotten rape victim who has been violated and inaccurately has been called “The Companion Case” in other filings of another alleged victim by the name of Jamie Jones who had reached out to Tracy for help getting Tracy’s phone number through Lynn Falanga State Department Investigator five months after Tracy was home from her horrific ordeal.
In court pleadings Tracy went from the companion case to the failed case when it was these very people who deliberately failed her case in order to use her evidence identity stolen witness statements stolen pictures of Basra Iraq of animals having sex and billeting motto “we do what we can to get you in Bed “and claimed them to be from Baghdad Green Zone where Jones claims she was assaulted this evidence was never from any where Jones has ever been during her 4 days in Iraq they were Tracy Barkers own experience in Basra Iraq.
I think its sad that another attorney who was the Texas Trial Association President also played a part of this by the name of Paul Waldner who held himself out as the Barkers attorney in 2007 with false pleadings and negligence Waldner was never hired by he Barkers or did they know he existed at all this man took part of these acts against Tracy Barker.
Ms Jones nominated herself as an advocate for Tracy and others who never knew her and never came through any foundation also Jones attorneys are the very Board members of Ms Jones foundation where they are getting contributions and held their selves out as Board members without Barker even knowing this foundation existed when they represented her. I must ask how someone who steals evidence and facts from Tracy’s case can portray themselves as an advocate.
In Jones case they claim Tracy was assaulted by her supervisor Craig Grabein but the very same day in Tracy Barkers case they claim quid pro quo that Tracy was having sexual favors with her supervisor for better working and living conditions. Basra had no different living conditions NO BARRACKS Jones has claimed Tracy was assaulted in Baghdad in the very same room she was assaulted in which is a lie
I know pleadings are not evidence but it legal and ethical for attorneys and a client that Tracy brought to them should be allowed to steal evidence call someone a companion case without knowing and deliberately do what they have done for Jones to get a trial stealing facts that happened to someone else in another part of the country and giving them to Jones to claim as her own including stealing emails photographs and eye witness statement of Tracy in Basra and claiming them to be about Jones in Baghdad Green Zone when they are not about any where Jones has ever been and should congressman Poe be allowed to lie about Tracy and claim he is helping her which he is not and never has? Joins these peoples media circus

What happened to Tracy Barker is a travesty, but still does not deserve an amendment that would apply too broadly. Her case should never have been sent to arbitration.

Why do you not even bother to answer my questions raised above? I have shown you a logical well thought out reason why I believe Jaime is deceitful, and yet you choose to obfuscate the debate and make it a personal one.

I would not have bothered being upset with this at all if we had not had e-mail contact outside of your website and if the whole reason you even HAVE a website is to help people like ME. At least that is what it started out as. As you got a little press, you expanded to throw every single thing, no matter how implausible and ridiculous up there to make waves and increase traffic.

That YOU can somehow pass judgment on a woman you have never met. I judge the validity of your injuries or claims….because believe me there are a whole lot of fakers out there. YOU are the one who started the trash talk about Jamie Jones. I disagree wholeheartedly with you stance. There are tons of people who disagree with me on this site. But I am not going to protect anyone who trashed a rape victim or a potential rape victim. I don’t care if you believe me or not. It’s not going to happen. So….that’s where I stand.
