DoD contractor discloses Social Security numbers for 269 employees

Almost daily we hear sad stories about how someone obtains the personal information of another and totally destroys their financial lives by stealing their identities and purchasing vehicles, homes, obtaining credit cards, utilities, medical services, drawing on social security benefits, committing crimes and the list goes on and on.  Companies such as LifeLock and FreeCreditReport.com are raking in millions helping people who are trying to avoid becoming victims themselves.

No matter how vigilant you are in protecting your personal information, there are some things that are out of your control.  What do you do when the company you work for has disclosed your name and social security number and apparently didn’t even notify you when this breach of information had occurred?

This in fact happened on January 20, 2009, when Data and Reporting Manager, Thomas Koch of  Stanley Baker Hill, LLC in Baghdad, Iraq emailed an Army document entitled “Personal Roster For Monthly Check Cashing” with the names and full social security numbers of 269 employees of and DAAR Engineering to a mailing list of 106 email addresses. Many of the email addresses were non government addresses such as gmail and yahoo.  What need-to-know did these 106 people have in order to be sent this highly sensitive information? NONE. In addition, many of the people on the list no longer work for Stanley Baker Hill, LLC and may not even realize this breach occurred. I did notice that Thomas Koch name and social security number are not on the list. According to one former employee on the list, Koch’s response to him when asked about this information breach was, “it’s no big deal”. NEWSFLASH!! It is a HUGE deal!

The DoD has very clear reporting requirements in place and are spelled out in  Department of Defense Directive 5400.11 DoD Privacy Program. So I have to ask, “When was this breach of information reported to the DoD?” Isn’t the violation of a DoD Directive by a DoD contractor a contract violation? Where is the DCMA in all this. Where is the Corrective Action Request (CAR)?

is clearly at fault here. Not only for the initial breach, but more importantly for not being pro-active in notifying the people on the list and leading the effort in mitigating the risk for potential . People screw up, it happens. But to not step up immediately and assist your employees in protecting themselves shows a clear lack of professional ethics and a total lack of concern for your employees. I am starting to wonder if the news of this breach has even reached the corporate offices of Stanley Consutants, Michael Baker Corporation, Hill International,  or DAAR Engineering. I have emailed each company to informed them of this article and asked for a statement. As of the publishing of this post, is the only company to respond.  David Higie responded with “No, we will not have a statement for the article.”  If anyone else responds, I will post an update.

As many of you already know, I too have all the documents involved in this breach of information. That in itself proves just how vulnerable every person on that list is. But, please be assured, I have no intention of further distributing, selling, or in any way compromising your identities. But you do have a right to know what I have done with the information. I sent the “unredacted” documents to an attorney in an effort to find out what kind of protections the people on the list are entitled to. I will keep you posted on that. I have sent the “redacted” documents to investigators on the Senate Democratic Policy Committee, Commission on Wartime Contracting, House Armed Services Committee, DoD IG/DCIS and DCAA. (“redacted” meaning only the names and the last 4 of the SS# are visible) I supposed if they want “un-redacted” documents they can request them from Thomas Koch or the DoD. There is no way of knowing who has sent these documents to whom. But you must assume that someone who is intent on committing identity theft has your name and social security number and you must take immediate action.

As many as 10 million Americans a year are victims of identity theft. In 2005, I was working in the Green Zone and became a victim of identity theft myself. I’m not 100% sure of how it happened, but someone was able to hack into my bank accounts and write themselves 1000′s of dollars worth of checks. Luckily, I monitor my money daily and caught it before any checks cleared and was able to recover 100% of my funds.

Every person on that list is a victim of an Information Breach and is at very high risk for identity theft.

This is what I recommend you do ASAP:

1. Contact your financial institutions and talk to a fraud specialist. Inform them of the breach of information and ask them what measure they can take to protect your cash assets. Some financial institutions may assist you with the entire process.

2. Immediately place fraud alerts with ALL three major credit reporting agencies and tell them there has been a serious breach of information within your company. I would call and talk to a real person rather than do it on-line.

3. Request a copy of your credit reports from ALL three major credit reporting agencies. You might be able to to that at the same time you are placing the fraud alert.  You are entitled to one free credit report annually from each credit reporting agency.  You can also request your reports here: www.annualcreditreport.com

4. Check your credit reports for accuracy. Each line item on your credit report should have a contact number for the creditor. Contact the creditor and verify each line item.

5. If you find inaccuracies or fraud:

a. Contact the creditor and dispute it immediately with the creditor and the credit reporting agencies.
b. File a police report with your local police department. This is very important.
c. File a report with the Federal Trade Commission

I strongly recommend you sign up for some sort of credit monitoring program. Something that will send you an email right away if there are changes such as new accounts or inquiries.  Personally, I prefer Triple Advantage via Experian. I get an email alert if there are ANY changes to my report and it ‘s affordable at $14.95/mo.  TrueCredit via TransUnion also has credit monitoring. I’ve had LifeLock but I prefer being able to access all three reports 24/7 as with Triple Advantage or TrueCredit. Personally, I would stick with one of the “big three” credit bureaus here.

Personally, I feel SBH should be assisting you with this. But, they aren’t so…..I will.

If you have been a victim of identity theft, shoot me an email so we can keep track of how many people have been victimized.

And please DO NOT giving out any more personal information to anyone for anything unless you are 100% sure of who you are dealing with. Not DOB, not mother’s maiden name, not DL# NOTHING!! Please by hyper vigilant.  This very well could affect your spouse and children as well.

Please make sure all the inspectors and other employees of Stanley Baker Hill and DAAR Engineering are aware of this information breach. I am hoping the AP, CNN or another major news outlet will pick this up. But…with the G20 Summit and the riots in Pittsburgh it’s difficult to get the attention of a reporter right now.

    Add me to the list as well. I forwarded this link to our local newspaper which did a similar story today about a Hospital sending confidential faxes to the wrong number for 2 Years!!! This is after the gentleman receiving them contacted the hospital, state dept. of HHS and the Governors office. Some people are just born stupid!! The bad thing is, you can’t fix STUPID.

Stay away from name calling and opinions….stick to the facts. Those are damning enough.     From the few dealings I have had with our new O6 commander CPT Hughes, he seems like a real “stand-up” guy. CPT Hughes seems like the kind of commander we all wish we had for a “manager” at SBH. Someone should contact russell.hughes.guest@dcma.mil and let him know about this blog and how the mission is being affected by the way morale is, and how the inspectors are being treated.

    I am very appreciative to all who are doing what they can for my husband. I am still trying to understand how all of this happened. I didn’t think finding who had the contract would be this difficult. I still have yet to find this information out. No one has answers and no one will speak with me. I get the “I’ll have someone call you” and they don’t. My husband served 6 1/2 years active duty in the Air Force, then took this job in Iraq again. He is a true hero, he loved what he did and took great pride in it. I think it’s sad this is how our heros are treated. My husband along with the other 18 who have died the same way were just doing their job, fighting so you and I can sleep well at night and this is how they are respected? I’m disgusted. I served 4 years with Adam in the AF and not once did we hear of situations like this. We knew the living conditions in Iraq were horrible b/c we lived in it, but never did we hear of electrocutions. They keep sweeping it under the carpet. Not this time, I won’t allow it. My husband was a fighter; he fought for me, his family and his friends. Now I fight for him. I devote every sec of my day to Adam and I won’t give up on him. I will put a stop to this. If someone would have just done their stupid job I’d still have my husband. I fear for the whoever is responsible, b/c they will hurt for this! I love Adam more than anything and he is my whole world, how dare anyone take him away from me!

    Amen Ms Sparky, well said. Senator Bob Casey has expressed concern that more facilities in Iraq have not yet been deemed “safe”. The Senators, General Stein, the commanders, the soldiers and the families need to know that as inspectors we are not allowed to work over 72 hours a week, and that for at least 50-60% of those hours we are doing admin work. With the limitations placed on us it will be a miracle if a “1st pass” through Iraq is completed by March when the Army is scheduled to be drawn back by 60% drawn down. How about the SBH “management” steps up and deals with this administrative mistake in a professionial manner, do some of their own admin work instead of passing it on to the inspectors and let us do our job as efficiently as possible – helping keep Americans safe.

    If I understand correctly, you were returned to your “parent company” before the end of contract(like many of the Fire guys),but still received a “nice bonus”. Was it a monetary bonus? In hopes that you would not make your grievances public? I know that the Stanley Group is to provide their employees of TF SAFE a 5% end of contract bonus, but not until the end of the contract. The company that placed me here did not offer such bonus….just curious??? Sorry you were STUCK working w/ Andy- I feel for ya.

    Remember the days when all we had to do was do our inspections, do the reports, and distribute them? I wonder why our “numbers” have dropped since then? Those were the days when someone in management actually looked at our reports, and there was only three of them. Things sure have changed, and it doesn’t look like they’ve changed for the best. Why was the only requirement for this job a Master’s License when I do more administrative work than anything? I’ve never had to do this much paperwork in the electrical field.

    Although there are four (at least) different parent companies, you were all working under one joint venture. At the very least HR practices within the same “parent” company should be administered the same across the board. I’m not a labor lawyer (so I will ask one) but one would think that implementing separation agreements in an inconsistent manner would be an HR managers (a real one) and corporate attorney’s nightmare.

    I know a few labor attorney’s and will ask around and get back to you.

    Here is my problem with TFS:
    When this all started I was working as a DoD Civilian firefighter at Ft. Campbell. (hard job to get) I was sitting at home one day when I got an e-mail from a SBH recruiter. They found my resume on the internet (assuming monsterjobs.com) the recruiter asked if I was interested in a position with TFS as a fire Inspector. I asked all the details i.e pay, length of contract, hours worked, etc. It all seemed legit! Next, Karen Marshall called and offered me the job and wanted a guarantee that I would come and work for 1 year and possibly 2. I told her yes but that I didn’t want to work for a company that is as F’ed as KBR. (already been to that circus) She said she could assure me that SBH was a stand up company and did not put up with the “shenanigans” of KBR. I accepted the position. I next put in my resignation notice at Ft. Campbell FD, they were not happy. Also, did I mention how hard it is to get into the Govt. GS system?? Well, it is. Anyways I resigned from Ft. Campbell and headed to St. Louis to in-process for SBH. What a cluster F**K!! The people there didn’t know whether they were coming or going. That was my first clue that this was going to be an adventure to say the least. After 3 or 4 days in STL we landed in Iraq. This is where I finally got to meet Ms. Marshall the same lady that acted so nice on the phone was suddenly seen in a different light. I finally get to Warrior and begin inspections and enjoy myself. Never had any problems with management or leadership at Warrior. Then one day out of the blue got an e-mail to contact Macdonald ASAP. I called and he fired me with no explanation other than TFS was downsizing. BS!! I go back to Baghdad to out-process and was given the silent treatment by everyone there. Never once got an explanation as to why we were fired. I know it wasn’t due to performance. I have tons of e-mails from Project Mgmt. and Chief Glembot stating what a good job I was doing. Had they told me, John you suck and you’re fired I could have lived with that. That was the end of my time with TFS.
    Now almost 5 months later I am finding out that my SSAN# was sent out across the Iraq theater and that other people who were “let go” were given compensation. In my book that is Bull S**T!! If they gave one person compensation they should have given it to all of us. When I was fired I was put in a serious bind. Not only did I not get paid anymore I didn’t have any insurance for my family and had one hell of a tax bill. Yes, the money was good but had I known it was only going to last a few months I never would have left Ft. Campbell. I am still looking for a job!! This sucks! I now know that KBR & SBH are no different. Same Circus Different Clowns!!!

    I was paid only until my termination date which was 6/2/2009. Then I was paid a 5% contract bonus and paid for All accrued time off then $6000 for what I dont know.

    Glen macdonald making $500k plus?? Thats a scary thought…no wonder TF Safe is a mess!!

    I do not believe that of the 130 some odd comments now on this post, anyone has ever said Thomas Koch distributed those names and emails with malicious intent. But, when he was notified of the breach and he did nothing to mitigate it, I feel that is negligent.

    Seriously fellow BREACH of PERSONAL INFORMATION friends, acquaintances, and those that I have NO CLUE of who you are (nor indication of your character) – The damage has been delivered to us for the rest of our lives! Personal finance protection is only good for……PERSONAL FINANCES! What about the rest? Our information has been blast across one of the most viral, hacked, unsecured internet regions of the world! And still, after over 8 months, our HR departments have not incorporated a mitigation plan to at least quell the distribution of our information (which is obviously still being distributed). I don’t know about the rest of you, but I think perhaps some $$CHA-CHING$$ needs to happen so WE can protect OURSELVES (and families) the way WE see fit for the rest of our lives.

    Just working behind the scenes on this. Trying to contact EVERYONE on the list and get media coverage. This has not been a priority for SBH and the parent companies for the last 9 months, I would expect them to jump now.

    Are all of you other guys out there who got released going to sign the new non-disclosure agreement? I know I sure will, all they can do is fire you…..again! Is this new agreement backdated? Do you have to have a notary when you sign it. I know a signature is no good in court unless it has been notorized to prove who signed it!! Just something to think about. For you guys who are still there, keep up the good work even though management is getting all the credit for what you do.

    You can’t “back date” a non-disclosure agreement. They are just trying to mitigate damage on their part. Too bad they haven’t spent the same amount of time mitigating the damage of disclosing the names and SS# of 269 people!!

    I filed a report with the Army and USACE sent me an email asking who, how and what was done to make sure this doesn’t happen again. I told them the who and that nothing was being done about it.

    If this is the response to their breach of information……you signing a new non disclosure agreement? I say Bullshit! I personally wouldn’t sign it. You can’t even imagine how many fiscal years I have gone through. This is not a fiscal requirement for the USACE. It must just be SBH and I would tell them to kiss he “F” off! But that is just me. What are they going to do??? Fire all their inspectors!

    SBH came out out with a new Non-disclosure agreement. I will take a look at it tomorrow and comment on this post. If you are no longer working for SBH it doesn’t apply to you. If they try to make it apply to to you, I suggest you tell them to kiss off!!

    As for the logistics of our physical locations prohibiting any legal recourse, I would suggest you tell anyone you talk to that we will all be home by mid Feb. While the govt. has been known to waste money before, I do not see any way that this sideshow can be extended another 6 months.

    1. By the time this contract expires on March 11th, the military is supposed to be drawn down by at least 60%.
    2. We are allready inspecting buildings that are being given back to the Iraqis within days.
    3. The current focus for money and people is in Afghanistan.
    4. The CAR aginst KBR has been released.
    5. All of this bad press will bring atention to what a circus this is and severely limit funding.
    6. The Army has solicited to hire its own inspectors to do the same work much cheaper and without our nutjob managers.

    While it is always a guessing game around here as to when this circus will leave town, I can say with much certainty that we will all be home in 4 – 4 1/2 months. At that time it will be easier for us all to stay in touch and see how this plays out without looking over our shoulder.

    As for a non-disclosure agreement, I guess the managements response is to try and hide what happened as opposed to trying to mitigate the damage.
