Detention in Iraq of U.S. Civilian Challenged

WASHINGTON (CN) – An attorney has filed a habeas petition for a civilian contractor who has been imprisoned at Al Asad Air Base in Iraq since November, and whom the U.S. military wants to court martial – though he is a civilian. David Breda Jr. says the military confiscated his passport, and claims he was “never officially notified of the nature of the pending charges which allegedly confer jurisdiction on the United States military to hold (him) against his will at Al Asad Air Base.”
Breda says he served 6½ years in the U.S. Army and was discharged as a sergeant in 2001. He was working for KBR as a civilian contractor when he was detained on Nov. 26, 2008.
His attorney, David Sheldon, says Breda, “a full-fledged U.S. civilian, is poised to be tried by military court-martial, something that has not happened to a U.S. civilian government employee or U.S. contractor in at least thirty-eight years. The United States military has confined Mr. Breda to the Al Asad Air Base in Iraq for more than 60 days beyond the expiration of his civilian contract in preparation for court-martial proceedings despite a series of Supreme Court decisions rejecting on constitutional grounds prior efforts to subject civilians to trial by court-martial. The asserted basis for the military’s actions is an ill-considered 2006 amendment to the Uniform Code of Military Justice (‘UCMJ’), enacted without hearings or committee consideration, that purports to subject certain civilians to trial by court-martial during ‘contingency operations.’ But this statute, if it even applied to Mr. Breda by its terms, cannot overcome the long line of Supreme Court precedent limiting court-martial jurisdiction to accuseds who, unlike Mr. Breda, are actually part of the active armed forces.”
Breda’s attorney insists, “The United States cannot hold Mr. Breda under restrictions tantamount to confinement in Iraq without the bail hearing to which a civilian defendant is ordinarily entitled, in the guise of proceeding with a court-martial that the United States military has neither the constitutional nor statutory authority to convene.”
Breda received an “other than honorable” discharge from the Army on March 9, 2001, and is not allowed to be re-admitted to the U.S. military, according to the complaint. On Nov. 26, 2008, one day before finishing his stint with KBR, he received a “Restriction in Lieu of Arrest” from Brig. Gen. Randolf Alles, the commanding general of Al Asad Air base. Alles also is commander of the 3rd Marine Aircraft Wing, which is stationed there.
“Because the Memorandum of Restriction in Lieu of Arrest also forbade Mr. Breda from any contact with Ms. Rachael Wright, a former KBR co-worker and former MWR (Moral Welfare and Recreation) Coordinator, the military has only intimated that Mr. Breda is being held in Iraq as a result of a complaint made by Ms. Wright on or about Nov. 6, 2008 wherein she alleged that Mr. Breda had inappropriately touched her on or (sic) Oct. 4, 2008,” according to the complaint.
Breda has a wife and children in Pearland, Texas.
His attorney demands a writ of habeas corpus and an order prohibiting the court martial, or a writ of mandamus and order of prohibition. (click HERE for original article)
Sounds to me like there was quite a bit of coordination between the Military and KBR to pull this off. Not condoning in any way his alleged offenses. But it’s my experience that normally KBR quietly sends home or transfers it’s alleged perps to another camp before the client gets wind, or just punish the victim. I wonder how Mr. Breda got thrown under the bus?

Well a “other than honorable” could be for one of a hundred reasons. This is obviously a he said she said situation with no witnesses because the DoJ would have taken this case a long time ago and he would not just be on restriction where he could walk around freely. Also if he did touch this person then why hasn’t he been charged with anything yet, when it’s been almost 3 months. Then where did he supposedly touch her and why did it take her over a month to say it happen. What is her past. Not taking sides but let’s be realistic with this.

As long as we are being realistic…it doesn’t matter what her past is and it may have taken her that long to speak up because KBR management sucks…..remember Jamie Leigh Jone? Also….my biggest question is why is he in a military prison and not escorted back to the State for charges?
Maybe you should go back and read the petition he is not in a military prison he is just restricted to the base. Also its obvious, the reason he is not in the States is because the Department of Justice declined to charge him with anything. That should tell you just how weak this case is. Seriously,if they had something he would already be charged. No one wants to take this loss because thats exactly what this is. Ask yourself if they had a case then why haven’t they charged him yet. It’s been 3 months that they have been holding him.

From what I read in his petition she said he touch her in appropriately. Which if he did then he was wrong but if he is being falsely accused because of other reasons the they should go after Rachael Wright.

They should release him to the States. That’s what they should do. Something fishy is going here. KBR must be involved with this somehow…..
I should be his lawyer then he would be sitting at home right now. Anyway they are holding him against his will because they don’t know what else to do and I’m sure he’s not still being paid because his contract was up 3 months ago. Are you sure your not the prosecutor because your ready to judge him guilty and hang him without knowing anything but that she said he did it and he said he didn’t. Maybe your the type that believes that if a female says he did it then he must have did it. Of course females don’t lie about things. maybe we should ask the Duke Lacrosse team about that, or Kobe, or the thousands of other men that were falsely accused of doing something.

I only have time to judge KBR…as far as I’m concerned whatever it is their guilty. Somehow they are involved with this whole thing. Has someone contacted this guys Senator or Congressperson? That’s how Ms Jones was released from her KBR kidnapping. My point in posting this article to begin with was to impress upon the other KBR employees that KBR is not your friend. They will not go the extra mile to make sure you are treated justly. They will throw you under the bus at the first opportunity…just my opinion though.

I would really have to agree with you on that. I believe KBR is behind this full throttle because I have not seen where they have made any effort to help with this situation. I could only imagine what kind of mental stress and anxiety he is probably going through and what has KBR done to help him. They may be pushing this because they have had so much negative attention and Mr. Breda is a victim in their game. KBR knows and so does the military that this case is a dog. That’s why he is still there and hasn’t been charged with a crime. Someone will have to answer for the unlawful detention of Mr. Breda, whether it is Rachael Wright, KBR, or the U.S. Military, some one will have to pay for the injustice done here.

On that we agree….KBR is somehow involved. They should have been fighting for him. I tell people all the time when they go over…they are on their own.

Where was it in the background check before he went overseas, where he never should have left from if he was ‘other than honorable discharge’ from the military?

I am not saying guilt or innocence but the fact that the guy has had his identification (passport) taken from him suggests wrongful imprisonment somehow.

I’m betting that Ms. Wright went directly to the military police to report the incident and bypassed the KBR security.
With a “less than honorable” discharge from the military should have stopped him from being hired at KBR or have they changed their hiring policy??
Man, when I went through in November there were some of the sketchiest low life people you’d ever seen. And not to mention the people who were grossly overweight and barely healthy enough to breathe on their own. It was looking like they’d let anybody through.
OTH discharge is nothing…he more than likely popped up “hot” on a urinalysis or something simple like that. If it were more serious they would have made it a “Dishonorable”. It sounds to me like somebody in uniform has a thing for the alleged victim, cause there is no way that the military is wasting those kind of resources for “touching”. A full out assault, maybe. For “touching”, that’s a little hard to imagine a courts martial for a guy being a jerk. It really does raise alot of questions about her position in the situation, cause if she know him so personally, and the alleged action was not a full out assault, it sounds to me like a case of hurt feelings more than anything else. The military is playing themselves with this one. Send the guy home.
Ms Wright was a rather lazy employee but she never struck me as a liar. If she says he did it, he probably did. Mr. Breda on the other hand was always involved in some shady dealings. He and the crazy KBR security girl he was hanging out with, along with Mitch and others planted porn in their supervisor’s hooch and then bragged about getting her fired. Al Asad MWR was full of these types and eventually they managed to get two back to back MWR supervisors, a technician, and even their manager fired at Al Asad within 6 months. All this really happened. I couldn’t make this stuff up if I tried folks. KBR never caught on to the fact that there was a full scale mutiny going on in the MWR. They didn’t care either. They just wrecked the lives of anyone who had enough guts to take more responsibility and seek advancement. Some folks lost their homes and their spouses because they were falsely accused of various non-crimes or sheer accusations and sent home. They were sent home without another thought to a terrible economy. If you are a horrible human being or you want to get paid for being mediocre, KBR is the place for you. You can do nothing while the hard workers get fired any time you want. That’s why I never applied for any promotions. Because I saw what happened to all the other good employees. Meanwhile the sh1theads remain employed to this day. And oh by the way, KBR stands for “Keep Bringin’ Retards”. David Breda is experiencing a little payback right now. I hope the charges are false so he can see what it feels like to be fired out of a livelihood based on lies. Breda is not the only one though. He was actually the mildest of the conniving crew at Al Asad. There were (and still are) much worse characters on the payroll.

I agree that KBR has some real doozy’s working for them. And the number of shady deals going on behind the scenes is limitless. It’s like a docudrama!! But…he is a civilian and should be tried in civilian court. I think that’s the issue. From what I understand he is being held at Al Asad against his will and without representation. He could be escorted back to the states and arrested and charged. If I have the facts wrong let me know.
Wow, reading the comments just brought flashbacks of that place and working for KBR. Being there in 2005 things were much different. You were quietly sent home and/or worse sent to an even more remote/less secure site if you had the courage to address an issue. It is definitely a “good ole boys club” out there. As a woman you were left to deal with it the best you could or just go home. Kudos to the brave military out there…they were fantastic. Never had to worry at all about them being rude or inappropriate. As for some of the men at KBR…especially my coworkers at the MWR…that was a much different and darker story. Luckily I got the heck out and found a much better job in Baghdad with another company that gave a damn
David Breda did it , the only thing that I question is why did she wait so long to address the issue she Ms.Wright broke a few rules herself as far as messing around with the Milltary and having a relationship with the soldiers which is a violation within it self .Breda admitted that he saw some naked pictures of her on her IPOD and he probably was curious as to what it would be like so being a man he approached her not knowing that she would tell on him , so he tried to leave before he got reported. this incident has gone a bit to far and as far as you Loki96 did you ever work with any of these people ? maybe you are the supervisor that got fired for porn and still trying to defend yourself a freak is what a freak does and that is always being engaged in risky situations.

You got to love the KBR “Good ole boy” policies. There is nothing fair and according to the laws, it doesn’t have to be fair. If they treated their people (especially the women) in the States they way they do in LOGCAP they would have been out of business years ago. We have to change the labor laws that apply.

The Senate Democratic Policy Committee Chaiired by Senator Dorgan D-ND is running a series of investigations into Contracting Waste Fraud and Abuse in Iraq. And the House Committee on Oversights and Government Reform has had some very powerful and fruitful hearings about KBR. We are going to just keep “pokin’ at em’”. The July 11, 2008 Senate DPC Hearing is the one on Solider Electrocutions. And the July 30th or 31st, 2008 House Committee on OGR were very interesting.
Corrine Hurbach was fired for emailing porn in Afghanistan as well. She climbed the ladder by turning people in for everything under the sun. One security guard was fired for stealing from the first KBR employee who passed away on the job in 04, whose possessions were in transport. This was when HR had qualified people, before it took a nosedive into the burn pit. There are numerous accounts of employee’s walking the line and not performing or adhering to the rules. Some electricians were fired for “insubordination” when they brought code issues and wouldn’t perform the work without written authorization for their supervisors.

With all the issues at Al Asad that place sounds like it has problems.
I have several comments on above “statements”.
It’s obvious that so many people think that they know the real story. So many people feel the need to tell what they think they know. First, off I am the supervisor that was terminated for having porn. Yes, that was my fault and I am certainly not blaming ANYONE for that. I went quietly not blaming a sole for what I had in my possession. Yes, several staff members knew I had the porn, they also came and watched it, and also while they watched it they were sipping another no-no…alcohol!! So please don’t try to act like an angel, everyone got away with so much for a very long time and probably still are!! What I do have a complaint about is how David Breda was completely out of his mind. When he arrived to Al Asad he tried to get into my pants as well as several other staff members there, was that sexual harassment? Of coarse; did anyone report it? No, our fault.
Upon me leaving, and packing…. MORE porn was found (that didn’t belong to me) and it was found after the initial search. It was planted there and it was planted by David and other staff members to include a security employee that David was sleeping with! How do I know, because the girl in security fessed up once she left the camp! She said that David was hell bent on getting me out of there. But I was already on my way out when he planted the porn. The staff during that time was filled with so many people; ex-military personal to be exact that could give a crap about why were truly there. Most of them hated me because I made them actually earn the 80 grand they were making!! As far as Rachel is concerned; no she isn’t an angel (NONE of the female MWR staff was!!!) but that doesn’t give that crazy bastar% the right to go and touch her and harass her. When Rachel told me what David did, it didn’t surprise me; however I was glad to hear that he was finally on his way out!! Believe me there were only a couple people on that staff that I can say did the “right” thing everyday, went to work and went home; however there were many of us that didn’t follow the rules and I am including myself. If you two are still working there, then that is a prime example of how people get away with breaking the rules ever day and still collecting your 80 or 90 grand. A lot of good people with the mission at hand got let go everyday for breaking the rules and no one is making excuses. However, the ones that could give a damn are still there, doing the same things and making people’s lives a living hell. David Breda was a cancer and he deserves everything he gets! So “mytwocentsworth” and “beentheredonethat08″, you have so much to say, but never said a word to help protect anyone on camp. But then again, why would you? With the exception of a couple people on that staff, the rest were all idiots, money hungry, conniving people that will all get what they deserve in the end! ME? My life couldn’t be more perfect! Does anyone have any info on if the PM for the B Sites was involved? He supposedly got his promotion from Area Lead at D&F after the three women he was dating got into a cat fight. So KBR with all of its corporate professionalism promoted and transferred him. In the real world he would have been terminated for conduct unbecoming of an officer of a corporation and not been eligible for rehire. (yes that is terminology for the public sector) Any info might be helpful to show a pattern of disregard for the law when it comes to protecting employees with “special privileges.” The B Sites were not the only ones to receive these special individuals via this type of transfer process.

The actions of the 3MAW command do not surprise me ! This command is known for trying to njp/court martial individuals with less than 30 days of service left in their contract. This gentlemen is not the first to suffer from this command and he won’t be the last! Makes me wonder? If it was a different wing would this even happen? Here’s some food for thought, If a civilian is subject to this type of treatment, imagine a MARINE!

i do not think the Militarty has any right to lock any civillian up, without the proper , so called “hearings” weather your guilty or not,or legal system just does not work that way and the UCMJ is not enforcable on civillians..On another note does anyone know about the days off policy, who get to make it up and change it,m we used to have progressive discipline, now it jsut a days off sentrence and you are not allowed ot put it on an RR, not paid anyway, after 80 hrs. So, why do we as employess sit and accept al the crap and why does not anyone appeal the days off one might get a write up for same thing another gets time off 3 days or 7 days seems to be ever changing, as long as this type of manaagement pratice is in place as longa s HR sit by and watches, KBR wil not retain any of the good quality people they need. Well so much for being fair and welcone to the world of i bet you cant get a job at home…It diffcult,and why its accepted who knows…ohh well gotta go check to make sure im in compliant wiht everything we need to be compliant wiht you know hat laynard, etc..always the small stuff..what the next ..”change” to policy, who knows…..drive carefully and no more downloading ..they are watching that too hahaha

Evidently the UCMJ does apply to civilians. But my question is….why is it not enforce consistently. I think there is still too much subjective enforcement. I would like to know if any KBR manager has every been subject to the UCMJ? Probably not.

UCMJ does apply to civilians:
On October 17, 2006 the Uniform Code of Military Justice (UCMJ) was amended to extend UCMJ jurisdiction over persons serving with or accompanying U.S. armed forces in the field in time of declared war or contingency operation (references (a) and (b)). Since then, commanders have had available this additional UCMJ disciplinary authority.

allhands, you need to wake up and smell the coffee brother. Us contractors fall under the discipline of the military, just as FYI said. I hope you don’t get caught doing something against the GO1, because they might not release you to KBR. And remember that you could always be handed over to the Iraqi courts, and that is why no one wants to work in the green zone anymore.

I found out who and how they did it after J was gone. I wished I would have known before she left because I wouldn’t let her get fired like that. Who knows what she has to go home to, what kind of bills she has, debt, kids, family to take care of. I would never change someones life like that! Yeah she was mean as hell but it was a fair mean. loki96, lestberealaboutthings and mytwocents have had opportunities to see how KBR operates upclose. To all of you,,,,when you were in orientation in Houston, running through the drill with the gas masks, the nbc suits and listening to how great KBR is, could you have imagined experiencing the backstabbing, poor management, nepotism and cronyism that actually went on once you got to your jobsite? Really, didn’t you have a clue when you looked around the rest of that big room and saw all of the knuckleheads and illiterates (most of them). I sure did. So, when I got to my jobsite, it was absolutely no surprise. Many strange things occured:
—Women who talked of a happy family in orientation, but got on the job started a relationship within the second month, with other KBR employees and military.
—Managers who hired unqualified family members.
Backstabbing and planting evidence to get others fired.
—Procurement personnel taking kickbacks from local vendors….MANY !
—managers who take kickbacks from procurement..SCOTT MOUNT at CAMP VICTORY ring a bell?
Scott Mount personally got a HUGE kickback from a local company that provided beds for Camp Blackjack, the beds were for kids,,all 6,000 of them, when a soldier sat on them, they collapsed, buckled. so, my carpenters had to reinforce 6,000 beds with wood, and we gave the beds back to the soldiers,,,,broken metal beds with wood screwed in the sides,,,LOL,,,sad, but true.
—Lazy employees who stay in their rooms all day….MANY !

It is now going on 3 years since this incident has taken place and yet it is not over. David has done his time but will carry a life long black X along with him for life unable to get a decent job since all jobs do require a back ground a since he has committed to of the same types of crime while (1) being in the Military and (2) as a civilian on a federal installation . Mr. Breda your career is over . The salon you wanted to open your dreams are shattered you’ll never ever be able to work around any kids or women you are getting what you well deserve and now your name comes up again in a civil matter just when you thought it was all over….ok enough of that lets put the truth out there hopefully some people still check this blog. This what really happen in the Jessica case the old MWR manager who got fired for porn at Al Asad.Yes she did have it !!!!!!, but when and after she got fired she was packing her room and found a couple of explicit DVDs under her mattress she knew they weren’t hers and someone had to plant them there, and David did it he borrowed her truck and her room keys were on the KBR MWR key chain he went into her room and place the porn under her mattress . He was the one who turned her in ,but afraid that the Security Department wouldn’t find her stash he made sure they found something , but they only found what Jessica had ..again she had already been terminated because of her stash she found the others while packing up her personal items . David did this by himself with no help , but because others were in his circle they were guilty by association no one knew the porn was planted until after the search took place . now there is the story and the truth yes Jessica had her own porn,,,but David planted more .

YES people still read this blog and every time they google “David Breda” these posts and comments will come up FOREVER because I have not intention of shutting down this blog. EVERY TIME someone does a back ground check his crimes will come up. Too bad KBR protected him for so long. Who knows how many other victims Breda has out there. Mrs. Davis what are you talking about? And why you didn’t come forward when and if you had the chance to – your comments are hereby muted. I previously blogged bout this case concerning the activities of KBR and it’s fearless leader, the Security Director, and the suspect involvement of two security personnel, one female and one male both of African American descent (and definitely not qualified to do one thing or another in relation to security duties.) They were as complicit in this incident and actually should have been charged by the military however, when it was brought to the Security Director’s attention he failed to act, report or do anything relevant to help the case be adjudicated.
